Apple iPhone 5 robber Arrested

On January 29th, 2013 at approximately 12:15 p.m. Transit Police officers from Area 1 received a radio call to respond to Boylston MBTA station for a report of a robbery in progress. While en route one of the officers was flagged down by an MBTA employee at the corner of Washington and West Street's who was off with both the victim and the suspected phone thief. According to the victim and a corroborating witness the situation unfolded as follows:

The victim, while at Boylston MBTA station, was holding his Apple iPhone 5 in his hand when suddenly a male, later identified as Derek Virgilio, 20 of Boston, snatched the phone from his hand and fled out of the station. The victim chased after Virgilio, upon reaching the top of the stairs an upstanding citizen realizing what was happening assisted the victim and prevented Virgilio from escaping. Virgilio at this time removed his own Apple iPhone 4 displayed it and pleaded that he hadn't done anything wrong. The tactic worked as it gave Virgilio enough time to take off running again.

Once again the victim pursued Virgilio along with an MBTA employee and the upstanding citizen. The chase continued down several streets where the trio eventually caught up to Virgilio on the corner of Washington and West Street's. Transit Police officers on scene recovered a black Apple iPhone 5 from the sleeve of Virgilio and it was positively identified as the victim's. Virgilio was placed under arrest for Unarmed Robbery and transported to Transit Police HQ for the booking process. Virgilio is expected to be arraigned sometime today in Boston Municipal Court.

You will not believe this one

On January 28th, 2013 at approximately 8:20 p.m. Transit Police officers from Area 3 were on patrol at Quincy Center MBTA station. While there their attention was drawn to a male, later identified as John Monroe, 32 of Roxbury, who was straddling his body in between the train and the platform. Monroe's actions were preventing the train doors from closing and delaying the train for the rest of its passengers. Officers proceeded in Monroe's direction, while en route the train attendant announced via the intercom system several times "Please clear the doors". Monroe ignored these requests and continued to stand in between the doors preventing their closure. Officers approached Monroe to ascertain what his issue was and subsequently discovered Monroe had a total 4 outstanding warrants in existence for his arrest. The warrants issued from multiple courts were for several different charges. Obviously Monroe did not take our advice seriously regarding what to do if you have a warrant and DO NOT want to be arrested by the Transit Police (Advice given here). Needless to say Monroe was placed into custody for the warrants and transported to Transit Police HQ for the booking process. Monroe will appear sometime today in Roxbury District Court.

You are probably wondering why Monroe would drawn such attention to himself...... we are too. No explanation was given.

Man arrested for Assault

On January 27, 2013 at approximately 6 p.m. Transit Police officers from Area 3 were dispatched to Broadway MBTA station for a report of an assault in progress. Upon arrival officers were met by a male and female victim who informed the officers they were set upon by another couple. Victims further informed the officers they boarded a northbound Red Line train along with their 2 year old daughter at Wollaston station. At this time they noticed a male, later identified as Joseph Pacheco, 43 of Weymouth along with his female companion (unidentified at this time) already on the train car and arguing loudly with one another.  While the train was traveling inbound, Pacheco on two occasions asked the male victim for a cigarette. The victim turned him down on both requests. However on the second request for a cigarette Pacheco was leaning over the victims' stroller/carriage containing their 2 year old daughter. The female victim/mother of the 2 year old demanded Pacheco back away from her daughter. Pacheco's female companion took exception to this request and began assaulting the female victim. The male victim intervened and was then attacked by Pacheco, at this time the train was pulling into Broadway station and the female victim along with her young daughter were able to vacate the train.

Pacheco and his female companion continued to assault the male victim, this time however Pacheco attempted to strike the male victim with a 40oz container of beer. The victim was able to elude the beer bottle and it shattered against the train wall.

Transit Police officers placed Pacheco under arrest for Assault with a dangerous Weapon (beer bottle) and Assault & Battery. At the time of Pacheco's arrest there was an outstanding default warrant in existence for his arrest issued from Boston Municipal Court for Shoplifting. Pacheco was transported to Transit Police HQ for the booking process and is expected to be arraigned in South Boston District Court sometime today. His unidentified female companion was able to flee prior to police arrival. Transit Police detectives will follow up to ascertain her identity.

Cell phone thefts

LA Times article re: cell phone thefts by tpdnews411

Electronic Device/iPhone safety tips

Earlier this week we informed our readers of an arrest Transit Police made regarding the robbery of an Apple iPhone. Unfortunately, thefts of smart phones/electronic devices (most notably Apple products) is a nationwide trend.  This trend often referred to as "Apple Picking" is for the most part a crime of opportunity. However there are things you can do to minimize the chances of being victimized while traveling on the T.

  • If possible avoid using your phone while on the MBTA except in cases of emergency/reporting via SeeSay or 911
  • Conceal expensive electronic equipment
  • Change the color of the ear buds, would be thieves look for the distinctive white ear plugs of Apple
  • Refrain from listening to music or wearing headphones while riding the system
  • Be aware of your surroundings at all times especially if you are using your electronic device
  • Be aware that most robberies of electronic devices occur near the train doors
  • Be alert for staged distractions
Transit Police Chief Paul MacMillan stated " public awareness campaigns are an invaluable tool in our goal to reduce thefts of iPhones and other electronic devices on the MBTA. Enforcement alone will not work, we need to remind our MBTA community they can take definitive steps to guard themselves from being victimized".  Of the 20 robberies this month, 13 have involved the theft or attempted theft of either an iPhone or Samsung Galaxy.

Police Chiefs around the country, including Chief MacMillan, have been working on this important issue with the FCC and cell phone carriers. Carriers are trying to make it harder for thieves to profit from stolen mobile devices. (check out story here)

In the unfortunate event you are a victim DO NOT resist, things can be replaced. Try to stay calm, hand over your device and attempt to observe the physical characteristics of the perpetrator so you can describe him/her later. Contact the Transit Police as soon as possible (immediately if practicable) after the event and report the incident. Our detectives will work diligently to get your property back and apprehend the offender. Also, if you have not done so already please passcode protect your iPhone, enable Find My iPhone and lastly download a Remote Data Wipe for iPhone. For more information or tips to protect yourself call the Intelligence Unit at 617-222-1170.

We have attached a short video produced and published by the New York City Police Department titled "Electronic Device Safety Tips". It is only 31 seconds in length but worth the watch.

Please contact the Transit Police with any information of criminal activity that has or is occurring on the MBTA. You can do so completely anonymously via SeeSay apps for iPhone and Android users or simply text 873873.

FAQ-Assaults,Body Odor, Alcohol .....

Due to an overwhelming response to our FAQ last Friday regarding Marijuana, we are back! Below are just a smidgeon of  inquiries, that may or may not be true, received by Transit Police. The response by tpdnews do not necessarily reflect the views and opinions of the Office of the Chief of Police or his Command Staff.  Or maybe they do......  :)--

Q.) Last week while riding my train and minding my own business, a very disgusting, disheveled type person sat next to me. Their body odor was so unpalatable, it was an assault on my nostrils. I was overcome with nausea.  I demanded they move to another seat. He rudely refused.  I called 911 and sent a message using SeeSay App to have him removed or arrested. I provided you with the train car # and the stop we were approaching. You NEVER responded !! Why ?

As a general rule, we encourage good personal hygiene habits be practiced by all. However after extensive research we were unable to locate any laws in Massachusetts which compels a person to have the pleasant aroma of rose pedals and lilacs billowing about their body before they can utilize a public conveyance on the MBTA. Body odor can be such a subjective topic, are you certain it was not your own breath blowing back in your face ?

Q.) This morning while riding on a Red Line train a woman was talking on her cell phone so loud I could not even hear myself think ! I wanted to grab the f***ing phone from her ear and smash it to pieces and give her a  f***ing smack to emphasize my annoyance. Good idea ?  Could/would I get in trouble ?

Hmmmm. Tough question... NOT !! Definitively not a good idea. Yes, you would get in trouble. We don't know what your definition of trouble is but this would be how it played out: a Transit Police officer would provide you with a ride in the back of a prisoner transport wagon to Transit Police HQ. You would be given a tour of our arrest processing/holding facility. You would spend some quality time with one of our jovial booking officers. You would meet all kinds of new and interesting people, i.e.  fellow arrestees, a bail commissioner, a defense lawyer, an assistant district attorney, a probation officer and a real life judge...... To all other write in's of a similar nature; No matter how annoyed your fellow MBTA passengers make you, Please, pretty Please with sugar on top, do not assault them. It will not be tolerated by the Transit Police.

Q.) I have a Charlie Card that is pre-paid for the entire month, this morning when I arrived at my T station I realized I left it at home. I would have been late for work if I returned and got it, so I followed in behind someone else. I was stopped by the T Police and received a 50 dollar ticket !This is total nonsense. You people SUCK !!!

Sorry, we don't understand your question.

Q.) Last week I read your blog about marijuana on the MBTA, thanks for clarifying. Very helpful. Ok so now I know I can't spark up while I'm on the T, how about if I want to drink a little Jack Daniels or some beer while rumbling down the rails to calm my nerves. I'll wrap it in a brown paper bag so no one will know what I'm doing. Okay ?

Although we appreciate you would go the extra mile and wrap it in a brown bag, the consumption and/or transportation of alcohol on the MBTA is prohibited. Oh, by the way, just a heads up for you. Even the newest recruit right out of the academy knows, when you are drinking a beverage from a container wrapped in a brown paper bag......its alcohol.

Q.) Is it possible for the MBTA to pass a law or at the least a policy, that on game night only Celtic or Bruin fans are allowed to take the T to North Station. I get really really ticked off when I see some jerk wearing the opposing teams' jersey while I'm on the T or walking through North Station.
Sorry, no can do. The MBTA and the Transit Police are committed to ensuring the safety and safeguarding the constitutional rights of all people....hey! wait a minute. Aren't you that guy from last week with the little plastic leprechaun hat, green and white painted face, the 1980's Larry Bird jersey, green corduroy pants and the old school green Converse sneakers. I thought we already explained this to you from your holding cell at TPD Headquarters....

Q.) Last night while at South Station I was approached by a young female, about 25, who stated she has been living on the street and was desperate to get home to Maine to be with her family. She begged me for 50 dollars for bus fare. I gave it to her. This morning she was there again giving the same sad story to another person ! I confronted her and she kicked me in the shin and told me to beat it. Can you get her to return my money ? Or if/when I see her again can I put her in a headlock and give her a noogie until she pays me back ?

Uhhhh No! A noogie, really ?  We thought those hijinks went out with the Three Stooges. For those of you not familiar with what a noogie is: the official definition "painful sensation caused by the rubbing of knuckles or fist to ones head". Please refer to Question 2 for any question remotely close to assaulting people within the confines of the MBTA system. In regards to her kicking you we can help. Call us.

Stay tuned for more FAQ...........
