Medford man Indicted. Statement from the Office of Attorney General

MEDFORD MAN INDICTED IN CONNECTION WITH MANUFACTURING, DISTRIBUTION OF COUNTERFEIT MBTA PASSES

Allegedly Distributed More than 3,000 Passes, Yielding More than $60,000 in Profit and Depriving MBTA in Excess of $225,000 in Revenue

BOSTON A Medford man has been indicted in connection with an alleged scheme to manufacture and distribute counterfeit Massachusetts Bay Transportation Authority (MBTA) passes, Attorney General Martha Coakley announced today. He allegedly distributed more than 3,000 counterfeit passes, making more than $60,000 in personal profit and depriving the MBTA of revenue in excess of $225,000.

Casey Kolenda, age 27, was indicted today by a Statewide Grand Jury on the charges of Counterfeiting (7 counts). He will be arraigned in Middlesex Superior Court at a later date.

“We allege that this defendant distributed thousands of counterfeit MBTA passes, making profit for his personal gain and defrauding the Commonwealth of hundreds of thousands of dollars,” AG Coakley said.

“The vast majority of MBTA users are honest, fare-paying customers, and they deserve nothing less than our full attention to criminal activity such as this,” said MBTA Transit Police Chief Paul MacMillan. “I want our loyal customers to know that MBTA Transit Police will continue to do all we can to prevent the distribution and use of fraudulent passes.”

Kolenda was arrested on March 31 without incident at his Medford home by Massachusetts State Police assigned to the AG’s Office and MBTA Transit Police Detectives. He was arraigned on April 1 in Somerville District Court and held on $150,000 cash bail.

At the time of his arrest, Kolenda had more than 60 counterfeit April 2014 LinkPasses and almost $7,000 in cash on his person. State Police subsequently executed a search warrant at his residence and seized additional counterfeit April 2014 LinkPasses, hundreds of MBTA five-cent cards, three skimmers, and the material and computer equipment used  to manufacture the counterfeit passes.

The investigation began in August 2013, after the MBTA Transit Police discovered the existence of hundreds of unauthorized tickets in use by riders on the MBTA’s subway and bus systems. The AG’s Office and the Massachusetts State Police joined the investigation into the production and distribution of alleged counterfeit tickets in September 2013. Through that investigation, authorities identified multiple monthly LinkPasses that were purchased legitimately and subsequently used to create hundreds of counterfeit tickets used by riders.

Authorities allege that Kolenda orchestrated a scheme to fraudulently create counterfeit $70 monthly MBTA subway and bus passes, known as “LinkPasses,” between October 2013 and March 2014. The investigation revealed that the electronic data stored on the LinkPass magnetic stripe was copied using a magnetic stripe reader, also known as a “skimmer.” The electronic data was downloaded onto the magnetic stripes of hundreds of MBTA stored-value cards that Kolenda purchased for as little as five cents at ticket kiosks.

Kolenda then allegedly disguised the counterfeit passes by applying contact paper that bore the production history of the original LinkPass, as well as the MBTA’s trademarked “T” logo. Similar in appearance and now encoded with the electronic data copied from the LinkPass, the counterfeit cards could be used at any MBTA fare gate in the same manner as the original pass.

The MBTA estimates that Kolenda is responsible for over 3,000 counterfeit MBTA passes in circulation from October 2013 through March 2014. The joint investigation revealed that these counterfeit passes bearing the electronic data of the original were distributed and used on a monthly basis by MBTA riders, sometimes more than 15,000 times in one month. Investigators estimate that the lost revenue attributable to the counterfeit tickets manufactured and distributed by Kolenda is in excess of $225,000.

The investigation is ongoing. These charges are allegations and the defendant is presumed innocent until proven guilty.

Assistant Attorneys General Greg Friedholm and Gina Masotta of the AG’s Public Integrity Division are prosecuting this case. MBTA Transit Police detectives, State Police assigned to the AG’s Office, the AG’s Digital Evidence Lab, Financial Investigator Bryan Freitas, and Victim Witness Advocate Ashley Cinelli were instrumental in this ongoing investigation.

Graffiti Vandal Identified:arrest warrant issued.

In the early morning hours of January 14, 2014 at MBTA Boylston Street station two vintage trolleys that were on display for the public to enjoy were vandalized.  The trolley that sustained the most damage was built in the 1950's by the Pullman-Standard Company based out of Lowell, Ma.

Transit Police announce today; Subsequent to an investigation an arrest warrant has been issued for Daniel Nelligan, 25, last known address in Allston for (Felony)Vandalism and Trespassing relative to the incident on 01/14/2014. The warrant was issued out of the Boston Municipal Court-Central Division after Nelligan failed to appear for his arraignment.  Lieutenant Detective Richard Sullivan of the Transit Police Special Crimes Unit stated, " The identification of Nelligan was the culmination of a joint investigation with our partners of the Boston Police and Boston University Police Department. Particularly, Detective William Kelley (BPD) and Officer Nancy O'Loughlin (BUPD), their vast knowledge and experience in graffiti investigations proved indispensable. In addition to the incident at Boylston station our investigation has led us to seek 3 separate criminal complaints against Nelligan for Vandalism. We have applied for and were granted 3 additional arrest warrants from Brighton District Court. In these instances we believe Nelligan vandalized locations in Allston". Lieutenant Sullivan also added " we are committed to identifying and in conjunction with the various District Attorneys prosecuting graffiti vandals who damage and/or deface MBTA property ".

Level 3 Sex Offender arrested at Oak Grove

Jeffrey Harrell
On July 2, 2014 at approximately 1:30AM Transit Police officers working in area 2 received a radio call to respond to Oak Grove MBTA station for a report of a male threatening an MBTA employee and refusing to leave the station. Upon arrival officers spoke with the T employee who informed them a male, later identified as Jeffrey Harrell, 54, of Dorchester, had missed the last train. Missing the train appeared to have angered Harrell as he began to verbally berate the MBTA employee and at one point was banging on the window to the booth the T employee was located. Additionally, Harrell was refusing to leave the station. Harrell's actions and decision not leave the station proved to be not such a wise choice as officers soon discovered Harrell, a level 3 Sex Offender (see Harrell's status here), had several warrants in existence for his arrest. Harrell was wanted out of Boston Municipal Court for Shoplifting, Roxbury District Court for Defrauding a Innkeeper and Destruction of Property, South Boston District Court for Open & Gross Lewdness and Dorchester District Court for Failure to Register as a Sex Offender. See something Say something works again !!!!!

really ?????
On July 1, 2014 a member of our MBTA community who follows our "See something Say Something" campaign did just that. While on the Ashmont platform at Harvard sq. MBTA station a 50 year old male from Cambridge decided to relieve himself utilizing a cup. Upon completion the male then dumped the contents into the pit. It appears....... he believed by shifting his body it somehow was acceptable to urinate into a cup while on the platform. The male then returned to his musical instruments that were set up on the platform and began to play music hoping patrons would drop money into his bucket.  However the male under estimated the power of our MBTA community and the "See something Say something" philosophy.

Transit Police responded and ejected the male. It was also determined the male was not properly permitted to perform within the MBTA system. The male will have a future date in court.
