Press Release: Awareness campaign sexual harassment/assaults on MBTA

Press Release

April 7, 2014
STOP Sexual harassment/assaults on MBTA

The Boston Area Rape Crisis Center, Fenway Health, Hollaback! Boston and the MBTA announced participation in a transatlantic effort to call attention to, address, and effectively respond to sexual harassment that happens on public transit systems worldwide. Global Guardian expands on the Boston campaign that started in 2008 regarding sexual assault and harassment on the MBTA. In this first year of what is expected to be a growing annual effort; five police forces based in Boston, London, Vancouver and Washington, D.C. will participate in the operation. Press conference will be held on the South Station concourse at 1:30pm on Tuesday April 8, 2014.

According to Joseph O’Connor, Superintendent-in-Chief of the MBTA Transit Police, "The MBTA and the MBTA Transit Police take sexual harassment seriously and will identify, arrest, and assist in the prosecution of offenders. We want the community to feel comfortable letting us know what they are seeing and experiencing because with their help we can make a difference." Gina Scaramella from the Boston Area Rape Crisis Center pointed to the upskirting incident from a month ago as a great demonstration of how everyone has a role to play. "In that case, it was the riders who let the police know that they observed an offender taking upskirt photos of women on public transportation."

"We are glad that everyone involved in this initiative is supportive of addressing harassment and violence that is targeted specifically at LGBT people," said Cara Presley-Kimball of the Violence Recovery program at Fenway Health. "We recognize the need for victims and bystanders alike to be able to speak about their experiences to both law enforcement and with other members of the community, however they are most comfortable," said Kate Ziegler of Hollaback! Boston.

MBTA General Manager Beverly Scott, PhD said, "Strong community partnerships are an important part of our ongoing efforts to maintain a safe transit environment for all of our customers." Global Guardian aims to improve the levels of reporting and access to services among victims of sexual offences and to create an environment on public transport networks around the world which does not tolerate intimidation and sexual harassment.

Transit Police will be providing flyers to the riding public with information to download onto their phones and mobile devices on the MBTA this week during the Global Guardian week of awareness. Joseph O’Connor, Superintendent-in-Chief of the MBTA Transit Police added, "We are heartened to see transit systems around the globe following Boston’s lead."

Global Guardian

A transatlantic police operation will take place this week across England, Canada and the United States to crackdown on unwanted sexual behavior committed on public transport networks.

Global Guardian
The operation, called Global Guardian, will run from Monday, April 7th to Friday, April 11th and will involve five police forces based in Boston, London, Vancouver and Washington, D.C.

The organizations taking part include British Transport Police (BTP), Metropolitan Police Service (MPS), Transport for London (TfL), Metro Vancouver Transit Police, Massachusetts Bay Transportation Authority (MBTA) Transit Police and Washington Metropolitan Area Transit Authority (WMATA).

Global Guardian aims to improve the levels of reporting and access to services among victims of sexual offences and to create an environment on public transport networks around the world which does not tolerate intimidation and sexual harassment.

These types of offences often go unreported across the globe as victims either worry they won’t be taken seriously, think it’s not important enough, or believe it is just part and parcel of everyday life.

Global Guardian will involve an increased number of uniformed and plain clothes officers from the three different countries stepping up patrols on trains, buses, tubes and metro services.

They will be advising the travelling public about the initiative as well as identifying any suspicious behavior across the transport networks.

Throughout the week of action each police force will be using the hashtag #GlobalGuardian to raise awareness of the campaign and to encourage people to report incidents that have happened to them on the transport network.

Chief Paul MacMillan, of the MBTA Transit Police in Boston, said: “We are pleased to participate in this initiative and hope to raise awareness to what we know is a crime that often goes unreported.  Our passengers should know that we take these incidents seriously and they should not tolerate this type of behavior.”

Speaking on behalf of the partners in London, Chief Superintendent Paul Brogden, of British Transport Police, said: “BTP, MPS and TfL have been working together over the last year to increase awareness and confidence amongst the public to report unwanted sexual behaviour.

“We know that this problem isn’t unique to London and are eager to share our methods and findings with other forces. We’re keen to work with our partners in America and Canada, as we want all victims to know that they are not alone and will always be taken seriously when they report an incident. Together we are committed to stamping out this type of behaviour from transport networks around the world.”

Acting Superintendent Colin Carswell, MPS Safer Transport Command, added: “If someone has made you feel uncomfortable on your journey, however minor it may seem to you, reporting it to police can help us target the perpetrator and prevent it happening to another passenger.”

Chief Officer Neil Dubord, of the Transit Police in Vancouver, said: “Sexual offending on public transportation is a global issue and is something that the Metro Vancouver Transit Police take very seriously. We are pleased to be taking part in this international initiative and are committed to continuously working with all our partners both locally, and globally, to rid our system of this type of behavior.”

Chief Ron Pavlik, of the Metro Transit Police in Washington DC, said: “Every customer has the right to expect a safe ride without fear of being sexually assaulted or harassed in any way.

"We are putting would-be harassers on notice that this kind of behavior will not be tolerated on DC's Metro system."

Medford Man arrested: Counterfeit MBTA Passes

Medford Man Arrested in Connection with Manufacturing, Distribution of Counterfeit MBTA Passes
BOSTON – A Medford man has been arrested in connection with an alleged scheme to manufacture and distribute counterfeit Massachusetts Bay Transportation Authority (MBTA) passes, Attorney General Martha Coakley announced today.
Casey Kolenda, age 27, was arrested without incident yesterday at his Medford home by Massachusetts State Police assigned to the AG’s Office and MBTA Transit Police Detectives. He is charged with five counts of Counterfeiting with Value over $10,000.
Kolenda is due to be arraigned this morning in Somerville District Court.
“We allege that this defendant orchestrated a scheme to manufacture and distribute counterfeit MBTA passes for his own personal gain while defrauding the Commonwealth of hundreds of thousands of dollars,” AG Coakley said. “Our investigation with the MBTA remains ongoing.”
“Demonstrating again that the MBTA will not tolerate fraud, Transit Police detectives worked closely with State Police investigators and the Attorney General’s office to bring these charges forward,” said MBTA Transit Police Chief Paul MacMillan. “Our honest, fare-paying customers deserve and expect our full attention to this type of illegal activity. Let this serve as a warning to anybody else who thinks they can perpetrate such fraud.”
The investigation began in August 2013, after the MBTA Transit Police discovered the existence of hundreds of unauthorized tickets in use by riders on the MBTA’s subway and bus systems. The AG’s Office and the Massachusetts State Police joined the investigation into the production and distribution of alleged forged tickets in September 2013. Through that investigation, authorities identified multiple monthly Link Passes that were purchased legitimately and subsequently used to create hundreds of forged tickets used by riders.
Authorities allege that Kolenda orchestrated a scheme to fraudulently create counterfeit $70 monthly MBTA subway and bus passes, known as “Link Passes,” between October 2013 and March 2014. The investigation revealed that the electronic data stored on the Link Pass magnetic strip was copied using a magnetic strip reader, also known as a “skimmer.” The electronic data was downloaded onto the magnetic strips of hundreds of MBTA stored-value cards that Kolenda purchased for as little as five cents at ticket kiosks. Kolenda then disguised the forged passes by applying contact paper that bore the production history of the original Link Pass, as well as the MBTA’s trademarked “T” logo. Similar in appearance and now encoded with the electronic data copied from the Link Pass, the counterfeit cards could be used at any MBTA fare gate in the same manner as the original pass.
The joint investigation revealed that hundreds of counterfeit passes bearing the electronic data of the original were distributed and used on a monthly basis by MBTA riders, sometimes more than 15,000 times in one month. Investigators estimate that the lost revenue attributable to the forged tickets manufactured and distributed by Kolenda approaches $200,000.
State Police officers assigned to the AG’s Office arrested Kolenda and then executed a search warrant at his residence yesterday afternoon. He is due to be arraigned today in Somerville District Court. Authorities allege that Kolenda manufactured the counterfeit passes at his home.
The criminal investigation is active and ongoing. These charges are allegations and the defendant is presumed innocent until proven guilty.
Assistant Attorneys General Greg Friedholm and Gina Masotta of the AG’s Public Integrity Division are prosecuting this case. MBTA Transit Police detectives, State Police assigned to the AG’s Office, and Financial Investigator Bryan Freitas were instrumental in this ongoing investigation.
