Point of Entry Policing: Quincy Adams MBTA

On June 29, 2014 at approximately 5:30PM Transit Police officers working in area 3 were conducting Point of entry Policing at the MBTA's Quincy Adams station. While there they observed a male, later identified as Daniel Gomes, 31, of Dorchester fare evade by "piggybacking" in behind a paying customer. Officers approached Gomes, who was in the company of a 26 year old male from East Boston, and subsequently discovered Gomes had 3 warrants in existence for his arrest issued out of Quincy District Court for the following; Larceny by Check under 250.00 3 counts, Brockton District Court for Larceny by Check under 250.00 and lastly Brockton District Court for Larceny Over 250.00. Officers also discovered Gomes' companion was in possession of stolen items from Lowe's Home Improvement. Gomes was placed into custody and transported to Transit Police HQ for the arrest booking process. Officers confiscated the stolen items from Gomes' companion and he will be summoned into Quincy District Court for Receiving Stolen Property at a later date.

South Boston man arrested at Andrew Sq. MBTA

On June 25, 2014 at approximately 4PM members of the Transit Police MOP Unit were on patrol at the MBTA's Andrew Sq. station. While there an MBTA rider , who had just exited from a route 10 bus, approached the officers and informed them while she was traveling on the bus a man seated in the rear had been openly "sniffing and eating" cocaine. The witness provided the officers with a description of the man and further informed the drugs were located in a candy tin can.

Officers boarded the bus and observed a male, later identified as Robert Hynes, 22, of South Boston seated in the rearmost seat who matched the description. Officers also observed an Altoids breath mint tin can on Hynes' lap. Inside the tin can officers located a small clear baggie containing a brown powdery substance believed to be heroin, a green leafy substance believed to be marijuana and 2 pills believed to be a controlled class B narcotic. Hynes was placed into custody for Possession of a Class A and B substance and transported to Transit Police HQ for the arrest booking process. It is expected Hynes will be arraigned sometime today in South Boston District Court.

Statement from Suffolk County District Attorney's Office


Victim Turns Tables on “Upskirt” Suspect, Gives His Photo to Police

 


BOSTON, June 25, 2014—A Norwood man is the first person in Suffolk County to be charged under the state’s updated “upskirting” statute after a woman gave police photographs she’d taken of a man who pointed his iPad’s camera up her skirt, Suffolk County District Attorney Daniel F. Conley said.

JOSHUA GONSALVES (9/19/90) was arraigned in West Roxbury Municipal Court on a charge of photographing an unsuspecting person in the nude.  The statute was updated earlier this year after the Supreme Judicial Court’s ruled against Suffolk prosecutors and found that the previous version of the statute on the books in Massachusetts did not provide protection against the act of photographing intimate parts of a person’s body otherwise covered by clothing.  The current iteration of the statute, signed into law March 7 at Conley’s urging, closed that loophole.

Assistant District Attorney Kristina Kerwin requested bail of $1,000 and that Gonsalves be ordered to stay away from all MBTA property in the event he is released on bail.  Judge Ernest Sarason set bail at $150 and granted the requested condition of release.

Kerwin told the court that Transit Police were called to the busway at Forest Hills MBTA station at approximately 5:45 p.m. yesterday, where they spoke with the 26-year-old victim.  The woman told officers that a man later identified as Gonsalves was standing in front of her as she waited for her bus but then disappeared from her line of vision.  She then felt something brush against the inside of her right knee and saw Gonsalves sitting on a bench and holding an iPad that was faced up the victim’s dress, prosecutors said. 

The victim was able to provide police with description of the individual as well as photos she had taken of him before he boarded a Route 34E bus and left the station.

 

As officers spoke with the victim, additional officers responded in the area of Washington Street and Granfield Avenue, where the bus Gonsalves had reportedly boarded was awaiting their arrival.

Gonsalves, who was holding an iPad in his hand when approached by police, was asked to exit the bus.  During a conversation with police, Gonsalves allegedly made statements that he had seen news reports that photographing up a woman’s skirt was not illegal, prosecutors said.

“Let’s make this explicit for anyone who missed the follow-up news reports,” Conley said. “Everyone has a right to privacy under their own clothes. Transit Police will arrest you and we will prosecute you if you violate it. We encourage anyone to come forward about this behavior, victims and witnesses alike.”

Gonsalves is represented by Charles Pappas.  He will return to court August 22.

UPDATE****** Mansfield Amtrak accident

On June 25, 2014 the Massachusetts State Medical Examiner's Office identified two male victims who were struck by a Northeast Regional Amtrak Train on June 22, 2014 in Mansfield. Identified were Zachery Keene, 26, of Raynham and David Curry, 28, of Foxboro. Further forensic testing is needed to positively identify the the 3rd victim , a female.

Transit Police, Mansfield Police and representatives of the Bristol County District Attorney's Office continue to investigate the accident. No further information is available at this time.

Norwood man arrested for "Upskirting".

On June 24, 2014 at approximately 5:45PM Transit Police officers working in Area 4 received a radio call to respond to Forest Hills MBTA station for a report of a man taking pictures up a woman's dress. Upon arrival officers were met by the victim who informed the officers of the following; while standing in the upper busway she felt "something" brush against her knees. When the victim looked down she observed a man's hand, between her legs, holding an Apple iPad with the camera on facing up her skirt.

The offending male then boarded a Route 34 bus and left the area. The victim however provided officers with a detailed description and the officers were able to locate and stop the bus on the corner of Washington Street and Garfield Avenue. As the officers boarded the bus they immediately noticed a male matching the description and holding an Apple iPad. Officers escorted the male, later identified as Joshua Gonsalves 23 of Norwood, off the bus for further investigation. Gonsalves admitted to the deed and stated to the officers he heard on the news it was not illegal to "take pictures up a girl's skirt". Gonsalves was placed into custody for "Upskirting" and transported to Transit Police HQ for the arrest booking process. It is expected Gonsalves will be arraigned sometime today in West Roxbury District Court.

On March 7, 2014 Governor Patrick signed into law Chapter 272 Section 105 making the offending actions of Gonsalves illegal. This law is also known as "Upskirting".

From 06/15/2014 to 06/21/2014 we have experienced 6 B&E Larcenies from Motor Vehicles at the Quincy Adams MBTA Parking Garage.

* 4 of the incidents have involved thefts of electronics, ie. iPods, GPS, computer and cellular telephones.

Malden man smashes out Orange Line train window, ends up in Jail.

On June 22, 2014 at approximately 3:30PM Transit Police officers working in Area 2 received a radio call to respond to the MBTA's Community College station for a report of a male slamming a brick into a Orange Line train car. Upon arrival officers observed a male, later identified as Stephen Fusco 46 of Malden,  standing in the entrance of the station. Fusco was shirtless and holding a brick in his hand. As officers approached Fusco he stated "Yeah I did it ".

Fusco was placed into custody for Malicious Destruction of Property. Subsequently officers discovered there was an warrant in existence for his arrest issued from Boston Municipal Court for Threats to Commit a Crime. Fusco was transported to Transit Police HQ for the arrest booking process. It is expected Fusco will be arraigned sometime today in Charlestown District Court.

The Orange Line train sustained 3 shattered windows located on two different doors, as a result the train had to be removed from service.

Amtrak train derailment-Fatalities confirmed

***update***  11:30AM 2 males and 1 female have been pronounced deceased as a result of the train accident in Mansfield. tpdnews.

On June 23, 2014 at approximately 12:01AM Transit Police officers received a radio call to respond to Mansfield for a report of a vehicle on the right of way that was struck by an Amtrak train. Multiple Transit police units responded along with Mansfield Police and fire. Transit Police personnel on scene report the following preliminary information; an eastbound Amtrak train, which had originated in Washington DC,  struck a vehicle (SUV) that was on the right of way near mile marker 200.44 causing the Amtrak train to derail. It appears the vehicle was occupied twice and both occupants have been pronounced deceased.

The incident is currently being investigated by Transit Police detectives, Mansfield Police and Massachusetts State Police. Significant service delays should be expected.

Cell phone snatcher- Snatched by Police

On June 19, 2014 at approximately 7pm Transit Police officers working in Area 3 received a radio call to respond to Andrew Sq. MBTA station for a report of a Robbery in progress. Upon arrival officers were met by the victim who informed the officers of the following; while walking through the lobby of the station the victim was in possession of his cellular telephone and US Currency which he was holding in his hand. Suddenly, a male came up from behind him and forcefully snatched the phone and money from the victim and fled. The victim pursued the offending male out of the station however the offending male made good his escape. The victim was able to furnish a detailed description of the offending male.

Officers conducted an area search and shortly thereafter located a male, later identified as Daniel Smith 26 of South Boston, on the corner of Gavin and Logan Way who matched the description. Smith was positively identified by the victim as the male who stole his phone and money. Smith was placed into custody and transported to Transit Police HQ for the arrest booking process. It is expected Smith will be arraigned sometime today in South Boston District Court for Robbery-Unarmed.

MBTA receives APTA's Gold Award for Rail Safety and Security 2014


American Public Transportation Association(APTA) presents the GOLD Award for Security to the Massachusetts Bay Transportation Authority (MBTA), Boston, MA

 “The MBTA Emergency Training Center is a state-of-the-art public transit emergency training facility located in Boston, Massachusetts. The facility opened in June 2013 and offers advanced training, exercise, and simulation capabilities in a realistic tunnel environment. The facility consists of multiple training areas, each dedicated to different transit modes or response functions, including heavy rail, light rail, bus, power, evacuation, as well as both law enforcement and fire response. The space that is now occupied by the MBTA Emergency Training Center began life in 1917 as an underground streetcar station. Only two years later, on October 14, 1919, the station was closed after being made redundant. In the years since, the abandoned space saw a variety of uses, including storing material and testing station accessibility enhancements. In 2009, MBTA officials began exploring the feasibility of converting the space into a state-of-the-art emergency training facility for transit. Through a grant from the Department of Homeland Security, this vision was fulfilled in 2013.”

Point of Entry Policing-06/13/14 JFK-UMass/ Braintree

On June 13, 2014 at approximately 5pm Transit Police officers working in Area 3 were conducting Point of Entry Policing at the MBTA's JKF/UMass station. While there they observed a male, later identified as Ahmad Braitwaite 43 of Boston, fare evade by "piggybacking" in behind a paying customer. Officers approached Braitwaite for the purpose of issuing a citation and subsequently discovered there was a warrant in existence for Braitwaite's arrest issued from Quincy District Court for Shoplifting. Braitwaite was placed into custody and transported to Transit Police HQ for the arrest booking process.

On June 13, 2014 at approximately 6:30pm Transit Police officers working in Area 3 were conducting Point of Entry Policing at the MBTA's Braintree station. While there they observed a male, later identified as Ryan Mortimer 31 of South Boston, smoking from a cigarette on the stairs which lead to the platform. Officers approached Mortimer for the purpose of advising him relative to the Commonwealth's Smoking Laws on MBTA property. Subsequently officers discovered there was a warrant in existence for Mortimer's arrest issued from South Boston District Court for 2 counts of Assault & Battery and 1 count of Assault & Battery with a Dangerous Weapon. Mortimer was placed into custody and transported to Transit Police HQ for the arrest booking process.

Level 3 Sex Offender Arrested at Harvard Sq. MBTA

On June 13, 2014 at approximately 8PM Transit Police Officers working in Area 2 received a radio call to respond to Harvard Sq. MBTA station for a report of an Indecent Assault. Upon arrival officers were informed of the following; an older male, later identified as Thomas Dabrikas 60 years of age who claims a homeless shelter in Boston as his residence, was observed Indecently Assaulting a younger male. The victim, an 18 year old autistic male, was not a willing participant and attempted to pull away from Dabrikas. Dabrikas, who was still on scene, was placed into custody for Indecent Assault & Battery and transported to Transit Police HQ for the arrest booking process. Dabrikas, a Level 3 Sex Offender (view Dabriskas' status here), is scheduled to be arraigned on June 16, 2014 in Cambridge District Court.

Missing Person Alert

UPDATE*** Mr.Bullins has been located safe and sound and is reconnected with his family.

The Boston Police Department is requesting the public’s help and assistance in efforts to locate Mr. Edward Bullins who was last seen in the area of 37 Vine Street in Roxbury on Thursday, June 12, 2014. Mr. Bullins is a 78 year-old black male who suffers from dementia. He is known to frequent both Jamaica Plain and Cambridge. He does have a MBTA pass and is known to wear house keys around his neck. Mr. Bullis is described as a 5’6” black male with gray hair and a medium build.

Lynn man arrested for Indecent Assault.

On June 10, 2014 at approximately 9:30PM Transit Police Officers working in Area 2 were on patrol at the MBTA's Lynn  Commuter Rail parking garage. While there they were approached by a female victim who informed the officers she was followed into the garage and indecently assaulted. The victim also furnished a description of the offending male. The officers conducted an area search and located a male fitting the description at the intersection of Washington and Monroe Street's. The male was positively identified as the offending male by the victim. Manuel Gomez ,56 of Lynn, was placed into custody and transported to Transit Police HQ for the arrest booking process. It is expected Gomez will be arraigned sometime today in Lynn District Court for Indecent Assault & Battery.

Point of Entry Policing Nets 3 on outstanding warrants.

The Transit Police Department has successfully employed a strategy/philosophy of "Point of Entry Policing". We believe by enforcing lesser crimes (at our points of entry) such as fare evasion, loitering and smoking we will deter the more serious crimes from occurring within the MBTA system. Oftentimes, those individuals who commit the above referenced crimes and are encountered by our officers are wanted for more serious crimes. The ultimate goal is to maintain a secure and safe transportation system for all to benefit from.

On June 9, 2014 at approximately 2PM a Transit Police officer working in Area 1 was patrolling the MBTA's State Street station. While there the officer's attention was drawn to several individuals who were drinking and loitering by the elevators near the entrance. The officer approached the group and a subsequent investigation revealed that two individuals of the group were wanted. Krystan McKenzie 29 of Malden had a warrant in existence for her arrest issued from Malden District Court for Disorderly Conduct and Lori Nicolazzo 34 of Boston had a warrant in existence for her arrest issued from Boston Municipal Court-Central Division for Trespassing. Both subjects were placed into custody and transported to Transit Police HQ for the arrest booking process.

On June 9, 2014 at approximately 7:06PM Transit Police officers working in Area 1 were patrolling the MBTA's Downtown Crossing station. While there the officers attention was drawn to a male, later identified as Carl Lawrence 44 of Weymouth, who was smoking from a cigarette near the southbound platform. Officers approached Lawrence to advise him relative to the Commonwealth's smoking laws. Subsequently, officers discovered there were several warrants in existence for Lawrence's arrest issued from Brockton District Court for OUI Liquor 2nd Offence, Negligent Operation of a MV, Operating a MV with a Suspended License and Speeding. Lawrence was placed into custody and transported to Transit Police HQ for the arrest booking process.

Transit Police K9 Spike enjoying his retirement.

In May of 2013 after 7 years of dedicated service Transit Police K9 Spike retired from duty. Spike was an exceptional police dog who during his illustrious career patrolled the MBTA system helping to keep a secure environment, fearlessly tracked down criminals, located lost and missing individuals and in his last year of service alone was part of a team which seized over 700,000 dollars worth of illegal narcotics. Transit Police Lieutenant Detective Richard Sullivan stated "Spike was one of the, if not the, best narcotic detection canines I have ever worked with. His ability to sniff out illicit drugs was truly amazing. The Transit Police owe Spike a debt of gratitude for his remarkable service in our efforts to reduce the availability of illegal drugs in our communities". 
Nowadays, one year into his retirement Spike enjoys his time by keeping active with his friend and former handler Transit Police K9 Officer Mike Carey.  As you can see by the photo's  Spike has not lost a step. Officer Carey has a new partner, canine Tika, who has some big paws to fill. However from what we have seen so far Tika is up for the challenge. tpdnews.

2 Juveniles caught stealing bicycles at North Quincy MBTA

Larceny Investigation
On June 8, 2014 at approximately 7:10 PM Transit Police officers working in Area 3 received a radio call to respond to North Quincy MBTA station for a report of several youths stealing bicycles with bolt cutters. Upon arrival of the first responding officer the offending youths began to flee in several different directions. With assistance from Quincy Police, officers were able to apprehend several of the offending youths, two of whom were positively identified by a witness as active participants. The bolt cutters were recovered from one of the offending male's back pack.

Two male juveniles, 13 and 15 year old residents of Boston, will be summoned into Quincy District Court (Juvenile Division) for Larceny and Possession of Burglarious Tools. The other aforementioned youths, whom the witness could not identify, were turned over to their parents.

New Hampshire man arrested for Indecent Assault

On June 7, 2014 at approximately 7:48 PM a Transit Police officer while at the JFK/UMass MBTA station was approached by a female victim who reported she was just Indecently Assaulted. The victim stated as she was walking up the stairs leading to the station a male walking parallel to her suddenly grabbed her and then Indecently Assaulted her. The victim was able to point out the suspect who was still inside the station.

The officer approached the offending male, later identified as Charles Williams 54 of Manchester, NH, and subsequently discovered there was an active arrest warrant in existence for Williams' issued from Lawrence District Court for Possession of a Controlled Class B Substance. Williams was placed into custody for Indecent Assault & Battery as well as the warrant. It is expected Williams will be arraigned sometime today in Dorchester District Court.

Transit Police investigate stabbing at Wonderland MBTA station.

Preliminary investigation suggests a 49 year old male and his 33 year old female companion had no prior familiarity with a 28 year old male prior to the incident. What precipitated the altercation remains under investigation. However at some point a verbal exchange occurred amongst the trio as they were inside Wonderland Station . At this time an inbound Blue Line train was in the station and the interaction escalated into a physical confrontation were the 33 year female sustained a non life threatening stab wound and her 49 male companion sustained a serious stab wound. Both victims transported to MGH for treatment.

Subsequent to information Transit Police received on scene TPD officers responded to Revere Beach MBTA station and placed a 28 male into custody. The 28 year old male, who furnished a Boston address, will be charged with Assault with Intent to Murder and Assault & Battery with a Dangerous Weapon (knife).

On June 6, 2014 at approximately 9:30PM Transit Police officers working in Area 2 received a radio call to respond to Wonderland MBTA station for a person possibly stabbed. Upon arrival officers located a male and female suffering from an apparent stab wound. Both victims, approximately in the 30's, have been transported to Massachusetts General Hospital for treatment. The female victim sustained a NON life threatening injury and the male victim has sustained a serious injury.  Transit Police have a male suspect in custody. Transit Police detectives are actively investigating the facts and circumstances surrounding the incident.

TPD Investigating Assault at MBTA Shawmut.

On June 4, 2014 at approximately 12:42 PM Transit Police officers working in Area 3 received a radio call to respond to Shawmut MBTA station for a person possibly stabbed. Multiple Transit Police units responded and were met by several witnesses, however officers could not locate a victim. Shortly thereafter Transit Police detectives located two teenaged males at different locations, apparently suffering from NON life threatening stab wounds. One male victim was located in the vicinity of Leslie Street in Dorchester and the second male victim in the vicinity of Dorchester and Welles Avenue. Preliminary investigation suggests the incident occurred on the southbound platform and may have originated on a Red Line train.

Both males have been transported to local area hospitals for treatment. Transit Police detectives are currently investigating the facts and circumstances surrounding the incident.

Boston man arrested for outstanding warrant

On June 1, 2014 at approximately 9 PM Transit Police officers working in Area 2 received a radio call to respond to Maverick Sq. MBTA station for an unknown problem. Upon arrival officers were met by a group of high school aged students from California visiting Boston on a class trip. They furnished the following information; while the students from California were playing Frisbee in the park adjacent to Airport MBTA Station one of them placed their Apple iPhone 4S on the grass in close proximity to the group. Subsequently, the California students alleged, a male later identifed as Kyle Harris-Dolan 23 of Boston, walked by and retrieved the phone and quickly proceeded to enter into Airport Station.  Harris-Dolan boarded an inbound Blue Line train, the students, who followed Harris-Dolan notified a station official who in turn contacted Transit Police.

Officers intercepted the train as it pulled into Maverick Sq. station and Dolan-Harris was positively identified as the person who absconded with the student's phone. Harris-Dolan  informed the officers as he was walking through the park he "found" the phone. The phone was reunited with it's rightful owner and officers soon discovered  Harris-Dolan was wanted out of Lynn District Court for Assault & Battery.  Harris-Dolan was placed into custody for the warrant and transported to Transit Police HQ for the arrest booking process. The students from California informed the officers based on their state of residence they did not wish to pursue any charges relative to the phone.
