Man attempts to steal phone-Arrested

On May 30, 2013 at approximately 7:40pm Transit Police officers from Area 1 received a radio call to respond to MBTA Tufts Medical Center station for a report of a robbery in progress. Upon arrival officers located a female victim who furnished the following information: while inside the station she was set upon from behind by a male who had grabbed her by the shoulders and demanded she turn over her cellular telephone. The victim refused, the male then forcefully attempted to rip the victim's cell phone from her hands. A struggle ensued which caused the victim to fall down a set of stairs resulting in minor abrasions to her facial area. The victim was able to maintain possession of her phone. The male attacker fled the station running out onto Washington Street.

Multiple Transit Police units conducted an area search and located a male subject, fitting the clothing and physical characteristics provided by the victim, near the corner of Tremont and Boylston Street. The victim positively identified the male, Joaquin Armaiz, 43 of Boston as her attacker. Armaiz was placed under arrest and transported to Transit Police HQ for the booking process. Armaiz is expected to be arraigned sometime today in Boston Municipal Court for Assault to Rob-Unarmed.

Man wanted for illegal firearm possession arrested by TPD

On May 28, 2013 at approximately 5:30pm Transit Police officers from Area 1 were on patrol at MBTA Park Street station (Winter Street entrance gate area) when they had occasion to observe a male later identified as Stevie Jaimon, 30 of Boston  enter through the fare gates without paying. Jaimon "piggybacked" in behind a paying customer. Officers approached Jaimon for the purposes of issuing a fare evasion citation, however officers soon discovered Jaimon was wanted (Boston Municipal Court) for illegal possession of a firearm. Additionally Jaimon also had warrants for his arrest issued from Cambridge District Court for operating a vehcile without a license and Boston Municipal Court for Possession of a Controlled Class D Substance with the Intent to Distribute. Jaimon was taken into custody and transported to Transit Police HQ for the arrest booking process and issued a citation for fare evasion.

On Monday, May 20, 2013, at approximately 9:45 AM, the male subject depicted below arrived at the Holland Street side of Davis MBTA Station on a bicycle. He was observed loitering near the bicycle racks for approximately 30 minutes, before placing his bicycle next to another bicycle, which he subsequently stole, leaving the original bicycle behind.

Update: Open & Gross incident on Red Line Arrest made *****

On May 23, 2013 Transit Police detectives sought the public's help in identifying a male who was wanted in relation to an Open & Gross incident that occurred on a Red Line train. (see posting here)
Shortly after the posting TPD received several tips regarding the identity of the male subject depicted. Subsequent to an investigation Transit Police detectives arrested Thomas Higgins, 21 of Quincy at Transit Police HQ. Higgins is expected to be arraigned in Quincy District Court for Open & Gross Conduct tomorrow.

Hot Dog man !!

On May 24, 2013 at approximately 5am Transit Police officers from Area 4 received a radio call to respond to Forest Hills MBTA station for a suspicious male. Upon arrival officers were met by an observant MBTA employee who informed the officers a male, later identified as Dana Reis, 56 of Medford, appeared to be setting up/opening a hot dog stand in the lobby of the station that did not belong to him.. The T employee went on to state they have never seen Reis before and the vendor who usually works at the stand does not arrive til later in the morning. Officers engaged Reis in conversation who stated he was "filling in for his friend". However Reis could not provide a contact number for his friend nor could he produce a permit authorizing him to sell hot dogs at Forest Hills. Subsequently officers discovered there was several warrants in existence for Reis' arrest issued from Worcester District Court (Larceny & Defrauding an Innkeeper) and Boston Municipal Court (for numerous drug violations). Reis was placed into custody for the warrants and transported to Transit Police HQ for the arrest booking process.

Lexington Man sells drugs to a UC

On May 21, 2013 Transit Police detectives working in a undercover (UC) capacity were at Quincy Center MBTA station to address issues of drug activity. While there a male, later identified as Scott McDevitt, 22 of Lexington, did sell a Controlled Class B substance- Suboxone- to a UC Transit Police detective. In addition to the drugs McDevitt sold he was in possession of additional Suboxone also for sale. McDevitt was placed into custody and transported to Transit Police HQ for the arrest booking process. Officers discovered McDevitt was also in possession of marijuana, less then an ounce, which he had stored in a cigarette box. McDevitt is expected to be arraigned today in Quincy District Court for Distribution of a Controlled Class B substance and Possession with Intent to Distribute a Controlled Class B substance.

Trespasser Struck in Montello Station

On May 21, 2013 at approximately 2:14 pm Transit Police officers from Area 3 received a radio call for a trespasser struck at the MBTA Montello Commuter Rail station located in Brockton. Multiple Transit Police personnel responded along with Brockton Police, Fire and EMS. Transit Police personnel on scene report the following preliminary information: a white male approximately 42 years of age trespassing on track 2 was struck by a Boston to Middleboro MBTA commuter rail train in Montello Station. The male has been pronounced deceased. Transit Police detectives along with Plymouth County District Attorney's Office are currently investigating the circumstances surrounding the incident.

Former Mass Most Wanted-Arrested by TPD

On May 17, 2013 at approximately 9pm plainclothes Transit Police officers from Area 3 were at JFK/UMass MBTA station on patrol when their attention was drawn to a male, later identified as Daniel Merrill, 28 of Somerville.  Officers overheard Merrill in a conversation with his companion use the words "buying" and "dealer". Merrill then suggested to his companion they wait on the platform. Shortly thereafter a northbound train entered the station and a male later identified as Derick Anderson, 40 of Dorchester, exited the train. Anderson and Merrill approached one another engaged in brief conversation then conducted a hand to hand transaction, ie. Anderson handed Merrill a white envelope and in exchange Merrill handed Anderson US Currency.  Officers approached both subjects and recovered the envelope from Merrill which contained Heroin. Anderson admitted to selling Merrill a "couple of bags" for 85.00 dollars. Both subjects were placed into custody and transported back to Transit Police HQ for the arrest booking process. During this process it was discovered there was an active warrant for Anderson's arrest issued from Dorchester District Court for violation of the Commonwealth's drug laws. Officers also discovered Merrill back in 2011 was featured on Mass Most Wanted (see story here ). Anderson and Merrill are expected to be arraigned in Dorchester District Court on Monday for various drug charges.

·         White male, approximately 35 years of age, heavy build, 5’5” to 5’7” in height, wearing a blue long sleeved shirt with black and blue stripped tie, black pants and was carrying a black backpack

Man who choked Bus Operator Arrested !

On May 8, 2013 at approximately 4:53pm an MBTA bus operator was driving a route 426 bus which had originated from Haymarket MBTA station. While in the vicinity of the 100 block on Lincoln Avenue in Saugus the bus operator pulled over to let passengers off. At this time a male passenger who was exiting  began to use foul language and insults directed at the operator. The bus operator confused as to what precipitated the male's anger towards him asked if the male was getting off the bus or remaining on board. The male did not respond but intently stared at the operator. The operator then closed the door and attempted to continue on. At this time the male shouted for the operator to stop and open the doors, the operator complied with the request and the male exited but remained in the doorway preventing the operator from closing the door. Suddenly the male re-boarded the bus and attacked the operator by placing both his hands around the operator's throat and choking him. At this time the bus was in gear but the operator had his foot on the brake. The operator was able to engage the emergency brake system thus preventing the bus from rolling forward.

Another male passenger who was witnessing the attack intervened and was able to extract the assailant's hands from the operator's throat and bring the assailant to the floor of the bus. The assailant was able to flee from the area.

On May 14, 2013 at approximately 11:30am Transit Police detectives subsequent to an investigation arrested Franco Contino, 59 of Saugus for the attack described herein. Contino was placed into custody at the MBTA Haymarket station and transported to Transit Police HQ for the arrest booking process. Contino is expected to be arraigned in Lynn District Court sometime tomorrow for Interfering with Public Transportation and Assault and Battery on a Public Employee.

Steak & Cheese, Pickles and an Assault ???

On May 11, 2013 at approximately 2pm a female, later identified as Tina Drouin 49 of Quincy, ordered a steak & cheese sub from Nathan's Famous Hot Dog's located at the MBTA Quincy Center station. While the Nathan's employee dutifully prepared her sub Drouin began to shout she was putting too much s*** on her sub and other derogatory comments regarding the preparation of the steak & cheese. It appeared the Nathan's employee could simply not please Drouin. Drouin then demanded a refund, when Drouin learned a refund would not be forthcoming she assaulted the sub maker by punching her in the facial area. As the sub maker attempted to defend herself Drouin pushed two large very heavy jars filled with pickles and pickle juice into the sub maker knocking her to the floor and shattering the jars. Drouin fled from the station, however the sub maker determined not to let Drouin escape justice gave pursuit catching up to her on Hancock Street near Quincy City Hall and holding her til Transit/Quincy Police arrived. Drouin claimed to be injured and was transported to a local area hospital for a complaint of neck pain. Drouin stated the whole incident began over "too many pickles". Transit Police will summon Drouin into Quincy District Court for Assault charges.

Select 24 hr TPD activity


On May 8, 2013 at approximately 11:13pm Transit Police officers from Area 1 received a radio call to respond to Back Bay Commuter Rail station for a disorderly party. Upon arrival a witness pointed out a male, later identified as Bazen Berhaine, 20 of Hyde Park who was causing a disturbance. Officers approached Berhaine and discovered there was a warrant for his arrest issued from West Roxbury District Court for Unarmed Robbery and Threats to Commit a Crime. Berhaine was placed into custody for the warrant and transported to Transit Police HQ for the arrest booking process. During this procedure Berhaine was found to be in possession of marijuana, less then an ounce and issued a citation for 100.00 dollars.

On May 8th, 2013 at approximately 4:40pm Transit Police officers from Area 1 were on patrol at Chinatown MBTA station when they observed a what they believed to be a drug transaction between a male and female, later identified as Karen Fennelly, 42 of Chelsea and Donnell Bailey, 42 of Malden. Officers approached and discovered Bailey, who was on the receiving end of the transaction, clutching a folded up piece of paper containing Heroin. Additionally, Fennelly was found to be in possession of Crack Cocaine. Both subjects were placed into custody and transported to Transit Police HQ for the arrest booking process. Fennelly and Bailey are expected to be arraigned today in Boston Municipal Court for violation of the Commonwealth's drug laws.

On May 8, 2013 at approximately 4:35pm Transit Police officers working in Area 2 were conducting fave evasion enforcement at Central Sq. MBTA station. While there they observed a female, later identified as Brittany Sousa, 24 of Boston,  fare evade by "piggybacking" in behind a paying customer. Officers approached Sousa to issue a fare evasion citation and soon discovered the was a warrant issued for Sousa's arrest from Boston Municpal Court-Central Division for Threats to Commit a Crime and Trespassing. Sousa was placed into custody and transported to TPD HQ for the arrest booking process. Sousa was also issued a fare evasion citation.

Repeat Groper Charged in Green Line Assault

BOSTON, May 8, 2013—A Salem man was on probation for groping two women at North Station when he allegedly groped a third on a Green Line train late last year, Suffolk County District Attorney Daniel F. Conley said.
DANE MULLIN (D.O.B. 4/26/86) was arraigned in the Boston Municipal Court yesterday on one count of indecent assault and battery for the Dec. 17, 2012, incident on a train traveling outbound on the E Line. Assistant District Attorney Jessica Erickson recommended that he be held on $20,000 cash bail; Judge Mark Hart Summerville imposed $8,000 bail and ordered him held without bail for allegedly violating the terms of his open probation and on open warrants charging him with failure to register as a sex offender and assault and battery, both out of Salem District Court.
Mullin was arraigned after an extensive investigation by MBTA Transit Police detectives into the December incident, in which Mullin allegedly groped a woman just before 7:00 a.m. between Haymarket and Government Center. The woman disembarked the trolley after the assault and notified MBTA personnel. She was able to provide detectives with a description of the assailant, whom Transit Police detectives believed might be responsible for two similar assaults.
Using surveillance images from multiple stations and after sharing information with local police departments, Transit Police detectives identified Mullin as a suspect in the Dec. 17 incident. Though the victim was unable to make a conclusive identification, detectives were able to locate Mullin and interview him, at which time he allegedly made incriminating statements admitting that he had touched the woman as he travelled from North Station to Park Street on a Green Line trolley.
Mullin pleaded guilty to two counts of indecent assault and battery in August 2011 for a pair of incidents at North Station on March 5 of that year. The assaults were committed against two women who did not know each other. He was sentenced to 2½ years in a house of correction with 18 months to serve and the balance suspended until July 31, 2013. He has prior similar convictions out of Cambridge, Chelsea, and Salem, and may face additional charges arising out of the Transit Police investigation.
Mullin was represented today by attorney Tracy Dudevoir. He will return to court on June 6.

MBTA Bus/pedestrian accident

On May 7th, 2013 at approximately 7:05pm Transit Police officers from Area 2 received a radio call for a MBTA bus/pedestrian accident in Melrose. TPD personnel on scene report the following preliminary information : an 88 year old man was struck by an MBTA route 131 (Melrose Highlands) bus at the intersection of Franklin and Pratt Streets in Melrose. The victim has been pronounced deceased.

Currently Transit Police detectives and the Middlesex District Attorney's Office are investigating the circumstances surrounding the incident.

Trespasser struck in Gloucester

On May 7th, 2013 at approximately 2:30pm Transit Police officers from Area 2 received a radio call to respond to Gloucester MBTA Commuter rail station for a person struck by a train. Multiple Transit Police personnel responded along with Gloucester Police, Fire and EMS. TPD units on scene report the following preliminary information : a male, approximately 57 years of age, trespassing along the right of way approximately 500 yards north of Gloucester Station was struck by an inbound MBTA commuter rail train and was pronounced deceased.

Passengers on board were bused and residual delays are expected.

Transit Police detectives and the Essex District Attorney's Office are currently investigating the facts and circumstances surrounding the incident.

Man arrested for Open & Gross Lewdness

On May 1, 2013 at approximately 6:32pm Transit Police from Area 2 received a radio call to respond to Revere Beach MBTA station for a disturbance. Upon arrival the officer observed a male, later identified as Lopera Zuluaga, 52 of Revere, fleeing out of the main entrance of the station. The officer was approached by witnesses who furnished the following: passengers/witnesses were travelling on a outbound Blue Line train, when the train arrived at Maverick Station Zuluaga boarded and positioned himself in a seat directly across from a very young female (approx.10 years of age). As the train proceeded on Zuluaga began to make inappropriate physical overtures directed at the young female. Shortly thereafter Zuluaga began to masturbate while glaring at the young female. Zuluaga attempted to hide his actions by placing a backpack over his groin area. A female passenger realizing what Zuluaga was doing began to yell and draw attention to the situation. This caused Zuluaga to cease his actions and attempt to exit the train. A male passenger who also observed Zuluaga masturbating confronted him informing Zuluaga he would have to wait for the Transit Police to arrive. A struggle ensued and Zuluaga was bale to free himself and flee out of the station.

Transit Police, assisted by Revere Police, conducted an area search and located Zuluaga on Nahant Street near the intersection of Shirley Avenue. Zuluaga was placed into custody and transported to Transit Police HQ for the arrest booking process. It is expected Zuluaga will be arraigned in Chelsea District Court for Open & Gross Lewdness sometime today.

Message from Officer Donohue

Message from Transit Police Officer Richard "Dic" Donohue:

I cannot begin to properly thank everyone involved in my recovery, as many fearless individuals stepped up and acted heroically that night. To start I must thank my brothers from the Transit, Boston, Harvard, Watertown, Cambridge and State Police, as well as fire department personnel and the various other first responders, all of whom put their own lives on the line to save mine. In the midst of a firefight they dropped to the ground and assisted me when I was shot. My family got through those first few days through the community's outpouring of prayers and endless support. I am told that when I arrived at the hospital I had almost no blood and no pulse, and the team of medical experts at Mount Auburn miraculously brought me back to life. I am now awake, moving around, talking, and telling jokes (much to my Wife's dismay). I am able to walk briefly through the use of a walker. My pain varies day to day and I still have a long road of rehab and recovery ahead, but I am optimistic I'll recover back to 100%. The bullet will remain in my leg as it is not obstructing anything or causing any pain. However my wife has informed me that the bullet will ultimately cause her the most pain, as I will be using it to get out of things such as mowing the lawn, doing laundry, and painting the deck.

My wife and I send heartfelt condolences to the Collier family. Sean was one of my good friends out of the Academy and I arrived on scene soon after Sean's attack. There is not a single day we are not thinking or speaking of Sean. And we are certain Sean was watching over me and assisted in saving my life. He could not save himself that night, but Sean could save me.

We want to again thank everyone for their prayers and concerns. I, however, have very little memory of the week's events and am working with officials to piece everything together. When the full story of that evening is accounted for, it will be wilder than any movie you have ever seen. And it will contain more heroes.

My wife and I understand the news value of what has occurred, but we ask you to give us the time and space we need during my recovery.
