On March 29, 2021 at approximately 4:30PM a Transit Police officer responding to concerns of individuals loitering and drinking alcohol at the MBTA Newmarket Station encountered a male, later identified as Rogelio Martinez-Vazquez, 39, of Boston. Martinez-Vazquez was sleeping on a bench with a shattered glass bottle of an alcoholic beverage strewn about. The officer woke up Martinez-Vazquez to ascertain if he needed any medical attention or other services. Martinez-Vazquez responded in the negative and the officer, who believed he exhibited signs of intoxication, spent several minutes requesting Martinez-Vazquez to find a more suitable place to sleep. Martinez-Vazquez refused initially but eventually walked off of the platform and headed in the direction of the officers cruiser. Once at the cruiser Martinez-Vazquez began to urinate directly on the officer's cruiser and moved his body in several directions in a attempt to urinate on as much as the cruiser as possible. Martinez-Vazquez continued this behavior while the officer was present and requested Martinez-Vazquez cease. Martinez-Vazquez additionally struck the cruiser's window with his hand.
The officer attempted to place Martinez-Vazquez into custody and he resisted, ultimately he was brought under control and transported to TPD-HQ for the arrest booking process.
