Our MBTA community comes through again !!! Subject identified and arrested.

On August 24, 2018 we issued a photograph depicting a subject of interest, relative to an Open & Gross Lewdness investigation, seeking assistance with an identification. (See posting here)  As a direct result of a tip supplied by a member of our MBTA community, Benito Hoyos, 34, of Cambridge was arrested on August 28, 2018 for Open & Gross Lewdness by Transit Police Detectives.

Senseless act of destruction lands Everett man in jail.

On August 23, 2018 at approximately 11:50PM a male, later identified as Peter Cuesta, 28, of Everett, entered into the MBTA's Mass Ave. station. Cuesta approached an MBTA employee and demanded she "badge" him in for free. When the MBTA employee refused Cuesta responded with foul language and proceeded to evade the fare by pushing his way through the gates. At this time the MBTA employee requested Cuesta leave the station. Cuesta refused and made his way to the platform to await the arrival of an Orange Line train. As the train arrived and came to a stop Cuesta, with a closed fist, punched the first door window of the head car causing it to spider web crack. Cuesta then entered the train car.


Transit Police officers assigned to the Central District responded and located Cuesta, still seated, inside the train car and removed him. Officers detected an odor of alcohol about Cuesta's person and placed him into custody for Malicious Destruction of Property and issued him a citation for Fare Evasion. Cuesta was transported to TPD HQ for the arrest booking process.

Revere man arrested at DTC for Indecently Assaulting a minor.

On August 16, 2018 at approximately 10:50AM Transit Police officers assigned to the Central District received a radio call to respond to the MBTA's Downtown Crossing Orange Line platform for a report of a minor who was Indecently Assaulted. Multiple TPD units responded and quickly located the offending male and witnesses. Based on information obtained on scene the following occurred: A male, later identified as Michael Brooks, 44, of Revere while travelling on an outbound Orange Line car began to stare at a female under the age of 14 in such a way as to make another male passenger suspicious and uncomfortable. As the train stopped at Downtown Crossing Brooks followed behind the minor child as she and her mother were exiting and Indecently Assaulted her.


The above referenced male passenger (identified) witnessed what occurred and stopped Brooks on the platform and would not allow him to leave the area until police arrived.


Prior to placing Brooks into custody he made incriminating statements to officers.


The Transit Police are extremely grateful to the male passenger who assisted in this ugly incident !!!!!

UPDATE: New York man found guilty for shooting at Maverick MBTA

New York Man Guilty in Maverick Station Double Shooting

BOSTON, Aug. 14, 2018—An MS-13 gang member from New York was convicted today of shooting a rival and a bystander at the Maverick MBTA station, Suffolk County District Attorney Daniel F. Conley said. 
After less than a day of deliberations, a Suffolk Superior Court jury convicted ROGELIO ALVARADO, 23, of two counts of assault and battery by discharging a firearm and single counts of unlawfully possessing a firearm and unlawfully carrying a loaded firearm. Jurors acquitted Alvarado of an additional count of armed assault with intent to murder. He faces sentencing at 11:00 on Aug. 20 in courtroom 815.
“Gun violence is the number one public safety threat facing Boston today,” Conley said. “If you pick up an illegal firearm, if you fire it in a public place, if you hit your target or a bystander or anyone else, we’re going to prosecute you. I want to thank the Boston and Transit police who responded to the scene and investigated the facts, the prosecution team who marshaled the evidence and the law for trial, the witnesses who stepped forward and testified to their observations, and the jurors who returned a fair and just verdict.”
During about three and a half days of trial, Assistant District Attorney Stacey Pichardo of the DA’s Gang Unit introduced evidence and testimony proving that Alvarado, a resident of Huntington, NY, had a gang-related conflict with a 29-year-old fellow passenger while traveling inbound on a Blue Line train on the afternoon of Jan. 19, 2016. The two men got off the train at Maverick Station.
Pichardo proved that Alvarado produced a firearm, sparking a physical altercation during which Alvarado shot the victim twice at close range. The victim was struck twice in the back. A second man, age 42, exiting the train at about the time of the conflict was struck as well, suffering a graze wound to the front of his head. Both men were transported to area hospitals and survived their injuries.
Pichardo introduced additional evidence that Alvarado fled the train station in a taxi and made his way back to New York. He was apprehended by Huntington Police on July 12, 2017, after driving the wrong way down a roadway and forcing other motorists off the road.
Edith Ayuso was the DA’s assigned victim-witness advocate. Pichardo was assisted at trial by Tiffany Albanese, a law student in the DA’s Gang Unit who served as second chair under Supreme Judicial Court Rule 3:03. Alvarado was represented by attorney John Tardif.

Fugitive from Justice nabbed by TPD after he fare evaded.

On August 13, 2018 at approximately 6:40PM Transit Police officers assigned to the Crime Suppression Team were at the MBTA's Andrew Sq. station conducting Point of Entry Policing. While there officers observed a male, later identified as Michael Marino, 51, of Lynn fare evade by "piggybacking" in behind a paying customer. Officers approached Marino for the purpose of issuing a citation and subsequently discovered there were several warrants in existence for Marino's arrest issued out of Falmouth District Court for Larceny of a Motor Vehicle, Destruction of Property Over 1,200.00, Numerous Motor Vehicle violations, being a Fugitive From Justice and Assault with a Dangerous Weapon.


Marino was placed into custody and transported to Transit Police HQ for the arrest booking process.
