On January 2, 2013 at approximately 2:30 pm Transit Police officers working in Area 1 were at MBTA South Station Commuter Rail maintaining order as several hundred patrons hustled to get home to beat the storm. While there their attention was drawn to a male, later identified as Joseph Regan
, 23 of Boston, who was smoking from a cigarette in close proximity to several "No Smoking" signs. Officers approached Regan and requested some form of identification for the purpose of issuing a citation. Regan claimed he did not have an ID on his person and furnished a false name and was evasive to questions regarding his identification. Ultimately officers were able to ascertain Regan's true identity; Regan had reason to mislead the officers as there were two warrants in existence for his arrest. The warrants issued from Malden District Court were for Breaking&Entering a Building at nighttime with Intent to commit a Felony and Larceny from a Building. Regan was placed into custody and transported to Transit Police HQ for the arrest booking process and issued a citation for smoking.
