Point of Entry Policing: Quincy Adams MBTA

On June 29, 2014 at approximately 5:30PM Transit Police officers working in area 3 were conducting Point of entry Policing at the MBTA's Quincy Adams station. While there they observed a male, later identified as Daniel Gomes, 31, of Dorchester fare evade by "piggybacking" in behind a paying customer. Officers approached Gomes, who was in the company of a 26 year old male from East Boston, and subsequently discovered Gomes had 3 warrants in existence for his arrest issued out of Quincy District Court for the following; Larceny by Check under 250.00 3 counts, Brockton District Court for Larceny by Check under 250.00 and lastly Brockton District Court for Larceny Over 250.00. Officers also discovered Gomes' companion was in possession of stolen items from Lowe's Home Improvement. Gomes was placed into custody and transported to Transit Police HQ for the arrest booking process. Officers confiscated the stolen items from Gomes' companion and he will be summoned into Quincy District Court for Receiving Stolen Property at a later date.

South Boston man arrested at Andrew Sq. MBTA

On June 25, 2014 at approximately 4PM members of the Transit Police MOP Unit were on patrol at the MBTA's Andrew Sq. station. While there an MBTA rider , who had just exited from a route 10 bus, approached the officers and informed them while she was traveling on the bus a man seated in the rear had been openly "sniffing and eating" cocaine. The witness provided the officers with a description of the man and further informed the drugs were located in a candy tin can.

Officers boarded the bus and observed a male, later identified as Robert Hynes, 22, of South Boston seated in the rearmost seat who matched the description. Officers also observed an Altoids breath mint tin can on Hynes' lap. Inside the tin can officers located a small clear baggie containing a brown powdery substance believed to be heroin, a green leafy substance believed to be marijuana and 2 pills believed to be a controlled class B narcotic. Hynes was placed into custody for Possession of a Class A and B substance and transported to Transit Police HQ for the arrest booking process. It is expected Hynes will be arraigned sometime today in South Boston District Court.

Victim Turns Tables on “Upskirt” Suspect, Gives His Photo to Police

 

BOSTON, June 25, 2014—A Norwood man is the first person in Suffolk County to be charged under the state’s updated “upskirting” statute after a woman gave police photographs she’d taken of a man who pointed his iPad’s camera up her skirt, Suffolk County District Attorney Daniel F. Conley said.

JOSHUA GONSALVES (9/19/90) was arraigned in West Roxbury Municipal Court on a charge of photographing an unsuspecting person in the nude.  The statute was updated earlier this year after the Supreme Judicial Court’s ruled against Suffolk prosecutors and found that the previous version of the statute on the books in Massachusetts did not provide protection against the act of photographing intimate parts of a person’s body otherwise covered by clothing.  The current iteration of the statute, signed into law March 7 at Conley’s urging, closed that loophole.

Assistant District Attorney Kristina Kerwin requested bail of $1,000 and that Gonsalves be ordered to stay away from all MBTA property in the event he is released on bail.  Judge Ernest Sarason set bail at $150 and granted the requested condition of release.

Kerwin told the court that Transit Police were called to the busway at Forest Hills MBTA station at approximately 5:45 p.m. yesterday, where they spoke with the 26-year-old victim.  The woman told officers that a man later identified as Gonsalves was standing in front of her as she waited for her bus but then disappeared from her line of vision.  She then felt something brush against the inside of her right knee and saw Gonsalves sitting on a bench and holding an iPad that was faced up the victim’s dress, prosecutors said. 

The victim was able to provide police with description of the individual as well as photos she had taken of him before he boarded a Route 34E bus and left the station.

 

As officers spoke with the victim, additional officers responded in the area of Washington Street and Granfield Avenue, where the bus Gonsalves had reportedly boarded was awaiting their arrival.

Gonsalves, who was holding an iPad in his hand when approached by police, was asked to exit the bus.  During a conversation with police, Gonsalves allegedly made statements that he had seen news reports that photographing up a woman’s skirt was not illegal, prosecutors said.

“Let’s make this explicit for anyone who missed the follow-up news reports,” Conley said. “Everyone has a right to privacy under their own clothes. Transit Police will arrest you and we will prosecute you if you violate it. We encourage anyone to come forward about this behavior, victims and witnesses alike.”

Gonsalves is represented by Charles Pappas.  He will return to court August 22.

UPDATE****** Mansfield Amtrak accident

On June 25, 2014 the Massachusetts State Medical Examiner's Office identified two male victims who were struck by a Northeast Regional Amtrak Train on June 22, 2014 in Mansfield. Identified were Zachery Keene, 26, of Raynham and David Curry, 28, of Foxboro. Further forensic testing is needed to positively identify the the 3rd victim , a female.

Transit Police, Mansfield Police and representatives of the Bristol County District Attorney's Office continue to investigate the accident. No further information is available at this time.

Norwood man arrested for "Upskirting".

On June 24, 2014 at approximately 5:45PM Transit Police officers working in Area 4 received a radio call to respond to Forest Hills MBTA station for a report of a man taking pictures up a woman's dress. Upon arrival officers were met by the victim who informed the officers of the following; while standing in the upper busway she felt "something" brush against her knees. When the victim looked down she observed a man's hand, between her legs, holding an Apple iPad with the camera on facing up her skirt.

The offending male then boarded a Route 34 bus and left the area. The victim however provided officers with a detailed description and the officers were able to locate and stop the bus on the corner of Washington Street and Garfield Avenue. As the officers boarded the bus they immediately noticed a male matching the description and holding an Apple iPad. Officers escorted the male, later identified as Joshua Gonsalves 23 of Norwood, off the bus for further investigation. Gonsalves admitted to the deed and stated to the officers he heard on the news it was not illegal to "take pictures up a girl's skirt". Gonsalves was placed into custody for "Upskirting" and transported to Transit Police HQ for the arrest booking process. It is expected Gonsalves will be arraigned sometime today in West Roxbury District Court.

On March 7, 2014 Governor Patrick signed into law Chapter 272 Section 105 making the offending actions of Gonsalves illegal. This law is also known as "Upskirting".

From 06/15/2014 to 06/21/2014 we have experienced 6 B&E Larcenies from Motor Vehicles at the Quincy Adams MBTA Parking Garage.

* 4 of the incidents have involved thefts of electronics, ie. iPods, GPS, computer and cellular telephones.

Transit Police have increased the number of uniformed patrols and utilization of plainclothes officers to directly address the situation. If you should observe any suspicious behavior please contact us immediately at 617-222-1212 or via our SeeSay app.

Malden man smashes out Orange Line train window, ends up in Jail.

On June 22, 2014 at approximately 3:30PM Transit Police officers working in Area 2 received a radio call to respond to the MBTA's Community College station for a report of a male slamming a brick into a Orange Line train car. Upon arrival officers observed a male, later identified as Stephen Fusco 46 of Malden,  standing in the entrance of the station. Fusco was shirtless and holding a brick in his hand. As officers approached Fusco he stated "Yeah I did it ".

Fusco was placed into custody for Malicious Destruction of Property. Subsequently officers discovered there was an warrant in existence for his arrest issued from Boston Municipal Court for Threats to Commit a Crime. Fusco was transported to Transit Police HQ for the arrest booking process. It is expected Fusco will be arraigned sometime today in Charlestown District Court.

The Orange Line train sustained 3 shattered windows located on two different doors, as a result the train had to be removed from service.
