On June 18, 2013 at approximately 9pm Transit Police officers assigned to Area 2 received a radio call to respond to the Brighton Street railroad crossing in Belmont for a vehicle on the tracks that was struck by an MBTA Commuter Rail train. Upon arrival officers located a vehicle on the tracks with substantial damage. Belmont Police, Fire and EMS also responded. Shortly thereafter a MBTA Fitchburg bound commuter rail train struck the vehicle.

The driver along with the two minor children were NOT injured and the driver was not cited. There was approximately 70 passengers on board and the MBTA immediately dispatched buses to pick them up and continue along the route. Waltham Auto and Tow removed the vehicle from the tracks.

Fare Evasion Update-Point of Entry Policing

The Transit Police Department employs a strategy/philosophy of "Point of Entry Policing". We believe by enforcing lesser crimes (at our points of entry) such as fare evasion, loitering and smoking we will deter the more serious crimes from occurring within the MBTA system. Oftentimes, those indivduals who commit the above referenced crimes and are encountered by our officers are wanted for more serious crimes. (for example click here).  The ultimate goal is to maintain a secure and safe transportation system for all to benefit from.

Thus far in 2013 Transit Police officers, while employing Point of Entry Policing, have issued 2166 fare evasion citations system wide on the MBTA.

Transit Police/Emigdio Diaz
On June 18, 2013 at approximately 9:30 am TPD officers performing Point of Entry Policing at the Ruggles MBTA station did observe Emigdio Diaz, 36 of Hyde Park, fare evade by "piggybacking" in behind a paying patron. Officers approached Diaz for the purposes of issuing a fare evasion citation and soon discovered Diaz had a warrant for his arrest issued from Framingham District Court for a violation of an Abuse Prevention Order.  Diaz was placed into custody and transported to Transit Police HQ for the arrest booking process and issued a citation for fare evasion.

Man Gets Jail Time for Assaulting MBTA Bus Operator

Man Gets Jail Time in Assault on MBTA Driver

BOSTON, June 4, 2013—A Marblehead man was sentenced to three months in a house of correction this week for head-butting an MBTA bus driver last year, Suffolk County District Attorney Daniel F. Conley said today.
JOHN KERIVAN (D.O.B. 12/10/64) pleaded guilty to assault and battery on a public employee yesterday as his trial was scheduled to begin in Chelsea District Court. Assistant District Attorney Thomas Ozbolt recommended that he serve a year and a half behind bars; Judge Benjamin Barnes imposed the lower amount, which was greater than the suspended sentence that the defendant requested.
Transit Police/John Kerivan
“No one should have to accept violence as part of their job,” Conley said. “That includes bus drivers. We’ll work hand in hand with Transit Police to identify, apprehend, and prosecute anyone who assaults an MBTA employee.”
Had the case proceeded to trial, Ozbolt would have introduced evidence and testimony to prove that Kerivan struck the driver on board a bus as it picked up passengers at Wonderland station on the night of July 23, 2012.
Specifically, Ozbolt would have shown that the driver pulled into the station at about 10:00 p.m. Among those waiting was Kerivan, who began screaming at the driver as soon as he boarded the bus. When the bus driver tried to calm him, the evidence would have shown, Kerivan head-butted him, knocking the driver off balance and disorienting him.
MBTA Transit Police found Kerivan in the station a short time later and took him into custody. The driver was released from duty for the day and received treatment at Massachusetts General Hospital.
