Assault at MBTA Broadway Station-Recognize them ?

On Sunday, March 9, 2014,  at approximately 9:00pm, three Red Line passengers were assaulted on a train at Broadway MBTA Station. This incident occurred as two passengers intervened to assist the first victim and they too were subsequently assaulted.  The original victim and the below described group were involved in a verbal dispute. Two other female passengers, who have no prior relationship to the first victim, intervened and asked the group to stop. Subsequent to that the group began to physical assault and beat all three victims.  

 The suspects were described;

 ·         WF, blonde hair, 18-25yrs of age, wearing blue jeans and a blue shirt carrying a flowered pocketbook 

·         WF, Brown hair, 18-25 yrs of age, wearing blue jeans black shirt white scarf, boots and a black purse 
·         WM, Wearing jeans, royal blue hooded sweatshirt, 15-20 yrs of age 
·         WM, 30-40 yrs of age wearing a red jacket and green sneakers 
·         WM, 30-40 yrs of age, wearing blue jeans, black sweater, black shoes, black jacket 
·         WM, 40-50 yrs of age, short hair, wearing jeans and a grey light weight jacket

Point of Entry Policing- Tufts Medical Center station

Giovanny Perdomo

On March 7, 2014 at approximately 2 pm Transit Police officers working in Area 1 were conducting Point of Entry Policing at MBTA Tufts Medical Center station. While there they observed a male, later identified as Giovanny Perdomo, 35 of Jamaica Plain, fare evade by "piggybacking" in behind a paying customer. Officers approached Perdomo for the purpose of issuing a citation and subsequently discovered there were several warrants in existence for Perdomo's arrest issued from; Boston Municipal Court for Possession of a Class A Substance, Roxbury District Court for Possession of a Class A Substance, Quincy District Court for Possession of a Class A Substance, Brighton District Court for Shoplifting over 100.00 and Chelsea District Court for Driving without a License. Perdomo was placed into custody and transported to Transit Police HQ for the arrest booking process. Perdomo was also issued a citation for fare evasion.

On Monday, 3/3/14, at 9:50 am, on an inbound Orange Line train entered Tufts MBTA Station. The individual depicted within robbed a patron of her bag. The suspect fled on foot toward Bay Village in Boston’s South End Neighborhood.

Community Alert ******* Quincy

On March 6, 2014 at the Quincy Adams MBTA parking garage Transit Police received reports of two separate incidents, they are as follows;

Community Alert

1)  at approximately 7:50 pm a female reported as she was walking on the second level of the Quincy Adams parking garage enroute to her vehicle she noticed a male staring at her and following her. The reporting party sought out other patrons also returning to their vehicles to walk with. When the male noticed this he crouched down between parked vehicles and began to crawl from one vehicle to the next. Upon reaching and entering her vehicle the male suddenly appeared at the passenger side door and was attempting to open the door. The male shouted for her to open her door. The reporting party was able to drive away and the male was unable to gain entry. He was described as follows; Black male, approx. late 20's, thin build,  5"10 tall, wearing a red colored shirt, blue jeans. His hair appeared to be long and possibly in a ponytail. 


2) at approximately 7:55 pm a female reported as she was walking to her vehicle, which was parked on the fourth level, she noticed a male hiding behind a wall. The reporting party walked past the male and she observed he got out from behind the wall and was following her. The reporting party was able to make it to her car and vacate the garage without further incident. She described the male as; light complected Black or Hispanic male, approx. 6"0 tall with a light colored knit cap.

After High Court Decision, DA Conley Urges Legislature to Criminalize “Upskirting”

BOSTON, March 5, 2014—Suffolk County District Attorney Daniel F. Conley today urged Massachusetts lawmakers to revise a law that the state’s highest court says does not forbid secretly photographing underneath a person’s clothes.

The Supreme Judicial Court today reversed a Boston Municipal Court judge’s order denying a motion by MICHAEL ROBERTSON (D.O.B. 3/3/82) of Andover to dismiss a criminal complaint charging two counts of attempting to secretly photograph a person in a state of partial nudity.

Prosecutors from Conley’s Appellate Division had argued that the statute criminalizes “upskirt” photography – the act of surreptitiously photographing beneath women’s clothing. The high court ruled that the current language of the statute does not forbid a person from pointing a camera or camera-enabled in such a manner as to photograph portions of the body otherwise covered by clothing.

“Every person, male or female, has a right to privacy beneath his or her own clothing,” Conley said. “If the the statute as written doesn’t protect that privacy, then I’m urging the Legislature to act rapidly and adjust it so it does.”

Robertson was arrested by MBTA Transit Police on Aug. 12, 2010, one day after riders reported seeing him taking pictures using a phone positioned near unknown women’s crotches. One rider even snapped Robertson’s photo and forwarded it to Transit Police, who sent out plainclothes female detectives to the area where those earlier offenses occurred.

Transit Police detectives boarded a Green Line train with Robertson and soon observed him to direct his camera-enabled cell phone toward one detective’s crotch from a distance of about two to three feet. Detectives also saw that a red light on the camera was illuminated, denoting a video recording in progress. They placed him under arrest for attempting to secretly photograph a person in a partial state of nudity under Ch. 272, Sect. 105(b) of the Massachusetts General Laws.

Robertson filed a motion to dismiss the case. A Boston Municipal Court judge denied that motion, and Robertson appealed to a single justice of the SJC, who reported the issue to the full bench. Prosecutors argued that the victim was partially nude for purposes of the statute because portions of her body intentionally covered by clothing were revealed by the surreptitiously-placed camera and visible through its lens.

The high court disagreed.

“[W]e interpret the phrase, ‘a person who is … partially nude’ in the same way that the defendant does, namely, to mean a person who is partially clothed but who has one or more of the private parts of body exposed in plain view at the time that the putative defendant secretly photographs her,” Justice Margot Botsford wrote in the eight-page decision. “A female passenger on a MBTA trolley who is wearing a skirt, dress, or the like covering these parts of her body is not a person who is ‘partially nude,’ no matter what is or is not underneath the skirt by way of underwear or other clothing.”

Assistant District Attorney Cailin Campbell argued against dismissing the case. Robertson was represented by attorney Michelle Menken.

Cell Phones for Soldiers

MBTA commuters can now contribute to the community’s environmental sustainability and at the same time provide the U.S. military service men and women the ability to connect with loved ones by simply dropping their old cell phones into collection boxes at the MBTA.  On February 21, 2014, the MBTA installed two drop boxes at North Station’s Commuter Rail concourse, these receptacles will collect cell phones for the non-profit organization Cell Phones for Soldiers. The charity was founded in 2004 by the Norwell, Mass., brother and sister team of Robbie and Brittany Bergquist, who were only 12 and 13 at the time. The MBTA started internally collecting cell phones for the charity in 2012, and has since racked up over 4,000 phones and provided 45,000 minutes of talk time for soldiers overseas. The drop boxes will be at North Station’s Commuter Rail concourse for two months, and then will be rotated at two-month intervals to South Station, Back Bay Station, then back to North Station. The cell phones will go to a company that refurbishes them, then sends money to provide pre-paid calling cards with phone minutes for soldiers overseas. Since 2004 the charity has collected millions of phones which otherwise would have ended up in landfills and have provided over 200 million minutes of talk time to service members overseas.

Point of Entry Policing- Quincy Center

Jeremy Riley

On February 28, 2014 at approximately 2:50 pm Transit Police officers working in Area 3 were conducting Point of Entry Policing at the MBTA Quincy Center station. While there officers observed a male, later identified as Jeremy Riley, 34 of Quincy enter through the fare gates without paying his fare. Officers approached Riley for the purpose of issuing a citation. Riley attempted to outsmart the officers and furnished a false name and social security number. The officers were undeterred and ascertained Riley's true identity which revealed there was a warrant in existence for his arrest issued out of Dorchester District Court for Operating a Motor Vehicle while being impaired by Drugs and Operating a Motor Vehicle with a Revoked License. Riley was placed into custody and transported to Transit Police HQ for the arrest booking process. During this time officers discovered Riley was in possession of prescription narcotics for which he did not have a prescription. It is expected Riley will be arraigned sometime on March 3, 2014 at Quincy District Court for violation of the Commonwealth's drug laws.

Riley was also issued a citation for fare evasion.
