Quincy man arrested for Indecent Assault & Battery

On December 28, 2016 at approximately 7:45PM Transit Police officers assigned to the South District received a radio call to respond to the MBTA's Riverside Station located in Newton for a report of an MBTA employee who the victim of an Indecent Assault & Battery. Upon arrival the officers were met by the victim who informed the officers of the following: while travelling on a Green Line trolley en route to Riverside a male, later identified as John Alves, 34, of Quincy indecently assaulted the victim. Upon arriving at Riverside Alves exited the train and approached another MBTA employee and stated "  I just wanted to give her a hug and kiss".


Alves was located nearby, positively identified and placed into custody for Indecent Assault & Battery. Alves was transported to Transit Police HQ for the arrest booking process. During this process it was discovered there was an arrest warrant in existence for his arrest issued from Brookline District Court for Receiving Stolen Motor Vehicle, Operating Recklessly and Operating without a License.

Wanted Fugitive nabbed by TPD

James Bonds
On December 28, 2016 at approximately 10:30PM members of the TPD's Crime Suppression Team were at the MBTA's South Station Red Line entrance when they observed a male, later identified as James Bonds, 47, of Cambridge enter without paying his fare. Officers approached Bonds for the purpose of issuing a citation and subsequently discovered he was a wanted fugitive from New Haven, Connecticut. The fully extraditable warrant issued for Failure to verify address as a Sex Offender, Assault in 3rd Degree and Assault & Battery on a Medical personnel was confirmed by Connecticut authorities. Bonds was placed into custody and transported to Transit Police HQ for the arrest booking process.

First Night Message From Chief Green

From 8PM until the end of service, the MBTA will not be collecting fares. The MBTA will have additional resources on hand and Transit Police Officers (both uniformed and plainclothes) will be on duty throughout the MBTA system to ensure a safe and efficient travel. I ask that you act responsibly and be respectful to one another. Additionally, please be mindful of young children, the elderly and persons with disabilities while riding the MBTA. The consumption and/or transportation of alcohol and unruly behavior will not be tolerated.

Fatality in Attleboro; Trespasser struck

Death Investigation
On December 24, 2016 at approximately 10PM Transit Police officers assigned to the South District received a radio call for a person possibly struck by an MBTA Commuter Rail train in Attleboro.

 Multiple Transit Police units, along with Attleboro Fire and EMS responded. Transit Police personnel on scene report the following preliminary information : at approximately 10PM a male, approximate age of 30's, while trespassing on Track 1 was struck by an outbound MBTA Commuter Rail train in the vicinity of 700 South Main Street in Attleboro. The male has been pronounced deceased as a result of injuries sustained. Transit Police Detectives along with representatives from the Bristol County DA's Office are investigating the facts and circumstances surrounding the incident. Foul play is NOT suspected.

Boston man assaults female at Back Bay Station

On December 19th, 2016 at approximately 4:30PM a Transit Police officer assigned to the Central District was on patrol at the MBTA's Back Bay station when his attention was drawn to a commotion near the fare gates. The officer proceeded in that direction and came upon a 21 year old female who was the victim of an assault. The victim was distraught and appeared to have sustained a facial injury. The female victim informed the officer of the following : while exiting an orange line train a male, later identified as a 53 year old resident of Boston, violently pushed her out of the way so he could exit the train. The victim requested an apology which was not offered. The victim in turn removed the male's eye glasses from his face and demand he apologize for his actions. As a response the male, with a closed fist, struck the female in the face. (An independent witness confirmed this account)


The female victim was transported by Boston EMS for treatment and evaluation to a local area hospital. The male will be summoned to Boston Municipal Court-Central Division for Assault & Battery.

Dorchester man punches out MBTA Train window

On December 17, 2016 at approximately 10:35PM members of the Transit Police MOP Unit received a radio call to respond to the MBTA's JFK/UMass station for a report of a passenger who "punched out a train window". Upon arrival officers were met by an MBTA employee who pointed out a male, later identified as Marco Haynes, 25 of Boston, and informed the officers Haynes for no apparent reason punched a train car window causing it to spider web crack. Officers approached Haynes, who was still seated inside the train. Officers detected a strong odor of alcohol about Haynes' person and subsequently discovered there were several warrants in existence for Haynes' arrest issued from Dorchester District Court for Assault & Battery on a Family/Household member, Resisting Arrest, Assault & Battery with a Dangerous Weapon 2 counts, Receiving a Stolen Motor Vehicle, Receiving Stolen Property Over 250.00 and Disorderly Conduct.


Haynes was placed into custody and transported to Transit Police HQ for the arrest booking process. Haynes will be additionally charged with Malicious Destruction of Property Over 250.00.

Everett incident 12/18/2016 MBTA Bus

On December 18, 2016 at approximately 2:25pm in the vicinity of 178 Elm Street in Everett a Route 110 MBTA bus was involved in an accident involving a pedestrian. A preliminary investigation by Transit Police detectives suggest the following: an MBTA bus operator, after having stopped in a dedicated authorized bus stop, was in the process of pulling away. The MBTA bus' speed at the time was approximately 3 to 5 miles per hour. At this time a male, a 58 year old resident of Boston, exited from a local area business and began to chase after the bus. The male ran off the sidewalk, entered into the street and began hitting the back of the bus in a apparent attempt to gain the operator's attention so he could board the bus. In doing so the male lost his balance and fell onto the street and partially under the bus. At this point in time the bus made contact with the male's leg.

The male sustained a NON life threatening injury and was transported to a local area hospital for treatment.

The incident remains under investigation at this time, however preliminary investigation suggests the bus operator's actions did NOT contribute to the incident.

$20k Bail for Defendant in Alleged Hate Crime

 

BOSTON, Dec. 16, 2016—A Malden man remains held on bail following his indictment on hate crime charges for allegedly beating a man with a brick in a bias-motivated assault, Suffolk County District Attorney Daniel F. Conley said.

STEPHEN FUSCO (D.O.B. 8/28/67) of Malden was arraigned today in Suffolk Superior Court on charges of violating a person’s civil rights, assault and battery with a dangerous weapon, and assault and battery with the intent to intimidate based on nation of origin.  At the request of Assistant District Attorney Christina Miller, Conley’s point prosecutor for civil rights violations, Clerk Magistrate Edward Curley set bail in the amount of $20,000. 

Fusco has remained held on $20,000 bail since his Aug. 5 arraignment in Boston Municipal Court.  A Suffolk County grand jury indicted Fusco in connection with the case on Nov. 8.  Today’s arraignment transfers the case from Boston Municipal Court to Suffolk Superior Court, where it will be adjudicated.

Miller told the court that shortly after 5:00 p.m. on Aug. 4, Fusco approached the 32-year-old victim on the commuter rail platform at North Station.  After questioning the victim about where he was from and whether he spoke English, Fusco allegedly struck the victim in the head with a brick, causing him to fall into the back of a stopped commuter rail train. 

The assault was witnessed by three Keolis employees who detained Fusco until Transit Police arrived.  Fusco had blood on his hands when approached by officers and allegedly made post-Miranda statements that he used a brick to strike the victim because his hand hurt from having hit another person earlier that day, prosecutors said.

The victim suffered a five-inch gash to his forehead and lacerations to his nose.  He was transported to Massachusetts General Hospital for treatment.

“There is no room for this kind of behavior in civilized society,”   Conley said.  “Everyone has the right to feel safe and secure, no matter who they are, where they’re from, how they worship, or what language they speak.  Violating those rights is a crime we take seriously in Boston and Suffolk County. I want to thank the civilian witnesses and Transit Police officers who stepped in to help the victim and took action to identify the assailant.”

Erica Baganza is the DA’s assigned victim-witness advocate.  Fusco was represented by Arnold Abelow.  He returns to court February 9.

Transit Police Superintendent Richard Sullivan echoed DA Conley's statement, " The Transit Police Department is committed to safeguarding the constitutional rights of all individuals regardless of their race, ethnicity, religious beliefs, sexual orientation or gender identity. We will vigorously pursue anyone who commits such despicable acts on the MBTA. Chief Green and I want to thank our most valued partners at the Suffolk County District Attorney's Office for their ardent prosecution of this case and our dedicated detectives and officers for their tireless efforts to ensure the defendant is held responsible".

Revere woman caught fare evading arrested on warrants

On December 7, 2016 at approximately 5:40pm Transit Police officers assigned to the Department's Crime Suppression Team were at the MBTA's Central Sq. station conducting Point of Entry Policing. While there they observed a female, later identified as Lisa Ferrarini, 46, of Revere fare evade by "piggybacking" in behind a paying customer. Officers approached for the purpose of issuing a citation and subsequently discovered there was a warrant in existence for drug violations issued from Boston Municipal Court-Central Division. Officers placed Ferrarini into custody and she transported to Transit Police HQ for the arrest booking process.


During this process Ferrarini was found to be in possession of several prescription medication for which she did not have a valid prescription. Ferrarini will be charged with Unlawful Possession of Controlled Substances.

Person arrested for Indecent Assault & Battery on Red Line train.

On November 30, 2016 at approximately 5:10PM a male victim reported to the Transit Police he was indecently assaulted while travelling on an inbound Red Line train in the vicinity of Andrew Sq. MBTA station. On December 6, 2016, after an extensive investigation by Transit Police Detectives, Adair DosSantos, 49, of Dorchester was placed into custody for the alleged offence at Andrew Sq. MBTA station by Transit Police.




 DosSantos was transported to TPD HQ for the booking process and was arraigned in South Boston District Court for Indecent Assault & Battery on a person Over 14 .

On December 5, 2016 at approximately 6:20PM Transit Police officers assigned to the Department's Crime Suppression Team were at the MBTA's Chinatown station conducting Point of Entry Policing. While there they observed a male, later identified as Omar Clapp, 38, of Dorchester evade his fare by "piggybacking" in behind a paying customer. Officers approached Clapp for the purpose of issuing a citation and subsequently discovered there was a warrant in existence for his arrest issued from Roxbury District Court for Indecent Assault & Battery and Dorchester District Court for two counts of Assault & Battery with a Dangerous Weapon.


Clapp was placed into custody and transported to Transit Police HQ for the arrest booking process.
