Boston man "piggybacked" in MBTA station then causes disturbance.

On March 30, 2014 at approximately 7:51 pm Transit Police officers working in Area 1 received a radio call to respond to Downtown Crossing MBTA station (Orange Line southbound platform) for an assault in progress. Upon arrival officers observed a male, later identified as Eric Schell, 49 of Boston, causing a disturbance inside the train. Officers approached Schell and requested he step out of the train so they could ascertain what his issue was. Schell refused and continued his tumultuous behavior using expletives and causing others to move away from him out of fear. The officers requested a second time and Schell ignored their requests yet again. Ultimately Schell stepped off the train, however his disruptive behavior continued and he began to scream derogatory names directed at a female patron. At this time Schell was taken into custody for Disorderly Conduct. As Schell was being escorted to a Transit Police cruiser he continued his tirade.

Officers spoke with the female patron, who was on the receiving end of Schell's rant, she stated the following: as she entered through the fare gates she noticed Schell had "piggybacked" in behind her. Before she was completely through the gates Schell was pushing her from behind and shouting  "Hurry Up".  (the patron had never met nor had a prior relationship with Schell preceding the incident).

It is expected Schell will be arraigned sometime today in Boston Municipal Court-Central Division  for Disorderly Conduct.

Dorchester woman caught selling drugs inside Red Line train.

On March 28, 2014 at approximately 1:10pm Transit Police detectives were travelling on a southbound Red Line train and observed a female, later identified as Rebecca Donahue, 42 of Dorchester distribute a controlled class C substance (Klonopins) to a male, later identified as Michael King, 30 also of Dorchester in exchange for money. This transaction took place inside the train car as it stopped at the JFK/UMass MBTA station in Dorchester.

Detectives approached the duo and placed them into custody. Donahue was found to be in possession of additional narcotics, a controlled class B substance (Suboxone). Both subjects were transported to Transit Police HQ for the arrest booking process. It is expected Donahue and King will be arraigned sometime on 03/31/2014 in Dorchester District Court for violation of the Commonwealth's Drug Laws.

MBTA Transit PD receives 3rd Re-Accreditation from CALEA

“Re-Accreditation” Status

On March 22, 2014, the MBTA Transit Police Department received its 3rd re-accreditation award from the Commission on Accreditation for Law Enforcement Agencies, Inc. (CALEA).   The Department was originally awarded accreditation status in 2005.

 Accreditation is a self-initiated evaluation process by which police departments strive to meet and maintain standards that have been established for the profession, by the profession. These carefully selected standards reflect critical areas of police management, operations, and technical support activities. They cover areas such as policy development, emergency response planning, training, communications, property and evidence handling, use of force, vehicular pursuit, prisoner transportation and holding facilities. The program not only sets standards for the law enforcement profession, but also for the delivery of police services to citizens.

 Under the leadership of Chief Paul S. MacMillan, the MBTA Transit Police Department was assessed in October, 2013 by a team of assessors.  The Assessment Team found the Department to be in compliance with all applicable standards for Accreditation.  To conduct the initial self-assessment and prepare for the on-site review of the accreditation standards by CALEA, Chief MacMillan appointed Officer Roberta Spinosa to serve as the Department’s Accreditation Manager.      

 
BENEFITS OF ACCREDITATION 

 The standards for accreditation impact officer and public safety, address high liability/risk management issues, and generally promote operational efficiency throughout the agency.  The benefits are therefore many and will vary among participating departments based on the state of the department when it enters the process.  In other words, the benefits will be better known when the department quantifies the changes that it made as a direct result of achieving accreditation.  Generally, these changes involve policy writing, facility improvements, and equipment purchases. Listed below are some of the more common benefits. 

 

Accreditation:


· provides a norm for an agency to judge its performance.

· provides a basis to correct deficiencies before they become public problems.

· requires agencies to commit policies and procedures to writing.

· promotes accountability among agency personnel and the evenhanded application of policies.

· provides a means of independent evaluation of agency operations.

· minimizes an agency’s exposure to liability, builds a stronger defense against lawsuits, and has the potential to reduce liability insurance costs.

Point of Entry Policing; Fields Corner/Park Street

On March 27, 2014 at approximately 9:45 am Transit Police officers working in Area 3 were conducting Point of Entry Policing at Fields Corner MBTA station. While there they observed a male, later identified as Hiep Pham, 41 of Boston loitering near the Ashmont Platform fence. This is an area known to Transit Police as a location where individuals will attempt to climb over to gain access into the station. Officers approached Pham to ascertain why he was loitering in the area and subsequently discovered there was a warrant in existence for his arrest issued from Quincy District Court for Vandalize Property and Larceny over 250.00. Pham was placed into custody and Transported to Transit Police HQ for the arrest booking process.



Michael Lowe
On March 27, 2014 at approximately 6:12 pm Transit Police officers working in Area 1 were conducting Point of Entry Policing at MBTA Park Street station. While there they observed a male, later identified as Michael Lowe, 26 of Chelmsford, fare evade by "piggybacking" in behind a paying customer. Officers approached Lowe for the purpose of issuing a ciatation and subsequently discovered there was a warrant for his arrest issued from Lowell District Court for Larceny by check over 250.00 and Larceny over 250.00. Lowe was placed into custody and transported to Transit Police HQ for the arrest booking process. Lowe was also issued a citation for fare evasion.

Quincy man arrested for Impersonating a Police Officer

On March 18, 2014 at approximately 5:25 pm Transit Police officers working in Area 3 were patrolling Quincy Center MBTA station when they were approached by two male victims who relayed the following: as they were parked in the "Pick up Drop off " area of the station they were approached by a male who identified himself as a police officer. The suspect male went on to demand the victims produce identification and then simulated speaking into his cell phone requesting "back up". The suspect male then ordered one of the victims to open the center console so he could see it's contents. At this time one of the victims requested the suspect male produce a badge and/or some form of police identification. The suspect male responded by unzipping his jacket and declaring " I don't need to show you anything ".  At this time one of the victims exited the vehicle and the suspect fled the area.

Shortly thereafter the victims observed the suspect male on the corner of Hancock and Granite Street, as they approached him he removed a box cutter from his waistband and waved it at the victims in a threatening manner and demanded they not inform anyone of what had transpired.

Subsequent to an investigation Transit Police obtained an arrest warrant for Michael Murray, 33 of Quincy for Impersonating a Police Officer and Assault by means of a Dangerous Weapon issued from Quincy District Court. On 03/27/2014 Murray was taken into custody by Transit Police detectives in Quincy and transported to Transit Police HQ for the arrest booking process. It is expected Murray will be arraigned sometime today in Quincy District Court.

Point of Entry Policing- Park Street MBTA

On March 26, 2014 at approximately 10 am Transit Police officers working in Area 1 were conducting Point of Entry Policing at MBTA Park Street station. While there they observed a male, later idnetified as James McGillicuddy, 21 of Boston fare evade by "piggybacking" in behind a paying customer. Officers approached McGillucuddy for the purpose of issuing a citation and subsequently discovered there was a warrant in existence for McGillucuddy's arrest issued from Boston Municipal Court-Central Division for Assault & Battery with a Dangerous Weapon and Possession of a Buglarious Instrument. McGillicuddy was placed into custody and transported to Transit Police HQ for the arrest booking process.

Good Samaritans come to the aid of robbery victim.

On March 25, 2014 at approximately 9:30 am Transit Police officers working in Area 1 received a radio call to respond to MBTA Downtown Crossing Station (Red Line platform) for an assault in progress. Upon arrival officers observed several individuals restraining a male, later identified as Cesar Gonzalez, 26 of Boston. The officers were informed of the following; a female victim was travelling on a red line train (Gonzalez was also present on the train) as the train stopped at DTC the victim exited and began walking on the platform. Suddenly Gonzalez came up from behind the victim and attempted to grab her purse. The victim held tightly onto her purse and was yelling for help. At this time several good Samaritans heard the victim screaming and came to her aid tackling Gonzalez to the floor and restraining him until the police arrived.

Gonzalez was placed into custody and transported to Transit Police HQ for the arrest booking process. During this time Gonzalez was found to be in possession of a brown powdery substance believed to be Heroin.  Gonzalez was arraigned in Boston Municipal Court-Central Division on 03/25/2014 for Attempted Unarmed Robbery and Possession of a Controlled Substance.

Plymouth man wanted by ICE arrested at South Station

On March 24, 2014 at approximately 10:45 pm a Transit Police officer working in Area 1 was patrolling in the area of the South Station Bus Terminal when his attention was drawn to a Nissan Maxima traveling at a high rate of speed on the onramp which leads into the bus terminal. This ramp is for authorized commercial buses only to pick up and drop off passengers. The officer initiated a stop of the Maxima inside the bus terminal adjacent to gate 13. The driver, later identified as Wanderson Dasilva, 27 of Plymouth, informed the officer he did not have a license but has been driving for 10 years. Dasilva also furnished the officer with a false name. A subsequent check of Dasilva's license status revealed he was not properly licensed to operate a motor vehicle in Massachusetts and there was a detainer placed on him by the US Immigration & Customs Enforcement Agency (ICE). Dasilva was placed into custody and transported to Transit Police HQ for the arrest booking process. Dasilva will be charged with Operating without a License, Speeding, Excluded Way violation and providing False name to Police in Boston Municipal Court-Central Division. ICE officials were also notified.

Four Arraigned in Subway Beatings

 

BOSTON, March 18, 2014—Three men and a woman were arraigned yesterday for their roles in the March 9 beatings of a 40-year-old man and a group of teens who came to his defense – including one alleged perpetrator on probation for an earlier, unprovoked beating, Suffolk County District Attorney Daniel F. Conley said today.

Arraigned today in South Boston Municipal Court were:

1.       MICHAEL DAVIS (D.O.B. 1/30/78) of Quincy, charged with one count each of assault and battery and assault and battery with a dangerous weapon;

2.      PATRICK J. JOYCE (D.O.B. 8/17/89) of Dorchester, charged with three counts of assault and battery and one count of assault and battery with a dangerous weapon;

3.      KEVIN McCARTHY (D.O.B. 12/2/92) of South Boston, charged with one count each of assault and battery and assault and battery with a dangerous weapon; and

4.      KRISTINE MULLEN (D.O.B. 8/4/93) of South Boston, charged with one count each of assault and battery and assault and battery with a dangerous weapon.

A fifth suspect has been identified as a 20-year-old South Boston man and is expected to appear for arraignment on assault and battery charges on March 21.

The defendants surrendered themselves to MBTA Transit Police last week amid the ongoing investigation. They posted bails ranging from personal recognizance to $500 after their arrests and yesterday walked into court, where Assistant District Attorney William Champlin recommended additional cash bail for a total of $1,000 bail each along with orders that they have no contact with the victims and witnesses, stay away from all MBTA property, and remain alcohol-free.

Prosecutors also notified the Probation Department of Joyce’s and McCarthy’s arrests in an effort to have them held pending surrender hearings because they are both on probation for serious offenses: Joyce for motor vehicle homicide in Norfolk County and McCarthy for aggravated assault and battery with a dangerous weapon in Suffolk County.

Judge Michael Bolden declined to order additional bail for any defendant, releasing Davis and Mullen on personal recognizance, Joyce on $400, and McCarthy on $500. Bolden imposed the stay-away and no-contact orders but not the order to remain alcohol-free.

McCarthy was convicted last year of taking part in the group beating of three men in the early morning hours of May 8, 2011. Suffolk prosecutors recommended three to five years in state prison followed by probation at his sentencing; a Suffolk Superior Court judge imposed two years in a house of correction with six months to serve and the balance suspended for two years. He and his co-defendants in that case shouted at the victims, “You [expletive] yuppie, you’re not from Southie” while beating them.

The defendants in this most recent case are accused of attacking a 40-year-old man and then the group of five Rhode Island teens, ages 14 through 18, when they attempted to help that victim. The older victim was transported to Tufts Medical Center with serious injuries. The teens were treated by Boston Emergency Medical Services at Broadway station but did not require hospitalization.

The ongoing investigation by MBTA Transit Police suggests that the incident was sparked by a brief exchange of words between the 40-year-old victim and the defendants’ group. That led to a physical attack by the defendants on that victim. When the younger victims stepped in to break up the attack, they, too, were attacked, the evidence suggests.

Transit Police utilized witness statements, footage from surveillance cameras, and video shot by passengers to develop the case. They released certain of that evidence to the public last week, leading the defendants to surrender themselves on Friday and Saturday.

“Transit Police recognized the seriousness of this case and the importance of identifying the attackers,” Conley said. “Fortunately, they had the help of multiple civilian witnesses who stepped forward to assist in the investigation. Those good men and women represent who we are in Boston, and I want to thank them.”

Davis, Joyce, McCarthy, and Mullen are represented by attorneys Robert Menton, Keith Nicholson, Craig Mulcahey, and David Mullen, respectively. They will return to court on May 23.

Arlington man arrested at Haymarket.

On March 17, 2014 at approximately 8:45 pm Transit Police officers working in Area 1 received a radio call to respond to Haymarket MBTA station for a report of an assault in progress. Upon arrival officers were met by two females who stated the following; while traveling on an Orange Line train the victims were approached by a male, later identified as Richard Botelho, 43 of Arlington, who began to verbally berate them. The victims requested Botelho leave them alone and they moved away to another section of the train. Botelho continued his harassment and then attempted to forcefully grabbed a cell phone one of the victim's was holding onto. As the victim and Botelho struggled for her phone Botelho spat on both victims and swung his fists wildly. At this time the train entered Haymarket Station and a male passenger intervened and subdued Botelho holding him on the platform until Transit Police arrived.

Botelho was combative towards the officers as well but was brought under control, placed into custody and transported to Transit Police HQ for the arrest booking process. It is expected Botelho will be arraigned sometime today Boston Municipal Court-Central Division sometime today for Assault to Rob Unarmed and Assault & Battery.

Point of Entry Policing- Quincy Center

On March 14, 2014 at approximately 10 PM Transit Police officers working in Area 3 were conducting Point of Entry Policing at Quincy Center MBTA station. While there the officers observed a male, later identified as Timothy Gruchy, 50 of East Bridgewater, pass through the fare gates without paying his fare. Officers approached Gruchy for the purpose of issuing a citation however Gruchy furnished the officers with a false name and social security number. Officers ultimately ascertained Gruchy's true identity and discovered he had several warrants in existence for his arrest issued from Waltham District Court for Failure to Stop for Police, Operating a Motor Vehicle after Suspension, Quincy District Court for Leaving the Scene Personal Injury, Operating after Suspension and Milford District Court for Operating a Unregistered Vehicle. Gruchy was placed into custody and transported to Transit Police HQ for the arrest booking process. He was also issued a citation for fare evasion.

Arrests made in MBTA Broadway Assault

On Tuesday March 11, 2014 we posted a video depicting persons of interest relative to an assault which occurred onboard an MBTA Red Line train as it entered Broadway Station.(see posting here). Subsequent to an investigation Transit Police detectives arrested Michael Davis, 36 of South Boston, Patrick Joyce, 24 of Dorchester, Kevin McCarthy, 21 of South Boston and Kristine Mullen, 20 of South Boston on March 14, 2014 after they presented themselves at Transit Police HQ. It is expected they will be arraigned sometime on Monday March 17, 2014 in South Boston District Court for various assault charges.

While there they observed a male, later identified as Zi Quan Ruan, 33 of Quincy fare evade by "piggybacking" in behind a paying customer. Officers approached Ruan for the purpose of issuing a citation and subsequently discovered there were three warrants in existence for his arrest issued from Quincy District Court for Shoplifting 2 counts, Providing False name to Police and Somerville District Court for Larceny Over 250.00. Ruan was placed into custody and transported to Transit Police HQ for the arrest booking process. He was also issued a citation for fare evasion.

Man exposes himself onboard an MBTA bus- Arrested.

On March 13, 2014 at approximately 9:30 am Transit Police officers working in Area1 received a radio call to respond to the intersection of Kneeland and Tyler Streets for a report of a male exposing himself onboard an MBTA bus. Upon arrival witnesses pointed out a male, later identified as Rafael Hernandez, 53 of Boston and informed the officers Hernandez, while seated , unzipped his pants and was fully exposing himself. Officers placed Hernandez into custody and transported him to Transit Police HQ for the arrest booking process. It is expected Hernandez will be arraigned sometime tomorrow at Boston Municipal Court-Central Division for Open & Gross Lewdness.

On Friday March 7, 2014 Transit Police issued a Community Alert relative to a male subject who followed two women in separate incidents (see Alert here) at the Quincy Adams MBTA parking garage. Subsequent to an investigation Transit Police detectives arrested Tyreke Mastin, 20 of Dorchester, earlier today at Hynes MBTA station. It is expected Mastin will be arraigned sometime tomorrow in Quincy District Court for Carjacking.

Assault at MBTA Broadway Station-Recognize them ?

On Sunday, March 9, 2014,  at approximately 9:00pm, three Red Line passengers were assaulted on a train at Broadway MBTA Station. This incident occurred as two passengers intervened to assist the first victim and they too were subsequently assaulted.  The original victim and the below described group were involved in a verbal dispute. Two other female passengers, who have no prior relationship to the first victim, intervened and asked the group to stop. Subsequent to that the group began to physical assault and beat all three victims.  

 The suspects were described;

 ·         WF, blonde hair, 18-25yrs of age, wearing blue jeans and a blue shirt carrying a flowered pocketbook 
·         WF, Brown hair, 18-25 yrs of age, wearing blue jeans black shirt white scarf, boots and a black purse 
·         WM, Wearing jeans, royal blue hooded sweatshirt, 15-20 yrs of age 
·         WM, 30-40 yrs of age wearing a red jacket and green sneakers 
·         WM, 30-40 yrs of age, wearing blue jeans, black sweater, black shoes, black jacket 
·         WM, 40-50 yrs of age, short hair, wearing jeans and a grey light weight jacket

Point of Entry Policing- Tufts Medical Center station

On March 7, 2014 at approximately 2 pm Transit Police officers working in Area 1 were conducting Point of Entry Policing at MBTA Tufts Medical Center station. While there they observed a male, later identified as Giovanny Perdomo, 35 of Jamaica Plain, fare evade by "piggybacking" in behind a paying customer. Officers approached Perdomo for the purpose of issuing a citation and subsequently discovered there were several warrants in existence for Perdomo's arrest issued from; Boston Municipal Court for Possession of a Class A Substance, Roxbury District Court for Possession of a Class A Substance, Quincy District Court for Possession of a Class A Substance, Brighton District Court for Shoplifting over 100.00 and Chelsea District Court for Driving without a License. Perdomo was placed into custody and transported to Transit Police HQ for the arrest booking process. Perdomo was also issued a citation for fare evasion.

1)  at approximately 7:50 pm a female reported as she was walking on the second level of the Quincy Adams parking garage enroute to her vehicle she noticed a male staring at her and following her. The reporting party sought out other patrons also returning to their vehicles to walk with. When the male noticed this he crouched down between parked vehicles and began to crawl from one vehicle to the next. Upon reaching and entering her vehicle the male suddenly appeared at the passenger side door and was attempting to open the door. The male shouted for her to open her door. The reporting party was able to drive away and the male was unable to gain entry. He was described as follows; Black male, approx. late 20's, thin build,  5"10 tall, wearing a red colored shirt, blue jeans. His hair appeared to be long and possibly in a ponytail. 


2) at approximately 7:55 pm a female reported as she was walking to her vehicle, which was parked on the fourth level, she noticed a male hiding behind a wall. The reporting party walked past the male and she observed he got out from behind the wall and was following her. The reporting party was able to make it to her car and vacate the garage without further incident. She described the male as; light complected Black or Hispanic male, approx. 6"0 tall with a light colored knit cap.

BOSTON, March 5, 2014—Suffolk County District Attorney Daniel F. Conley today urged Massachusetts lawmakers to revise a law that the state’s highest court says does not forbid secretly photographing underneath a person’s clothes.
The Supreme Judicial Court today reversed a Boston Municipal Court judge’s order denying a motion by MICHAEL ROBERTSON (D.O.B. 3/3/82) of Andover to dismiss a criminal complaint charging two counts of attempting to secretly photograph a person in a state of partial nudity.
Prosecutors from Conley’s Appellate Division had argued that the statute criminalizes “upskirt” photography – the act of surreptitiously photographing beneath women’s clothing. The high court ruled that the current language of the statute does not forbid a person from pointing a camera or camera-enabled in such a manner as to photograph portions of the body otherwise covered by clothing.
“Every person, male or female, has a right to privacy beneath his or her own clothing,” Conley said. “If the the statute as written doesn’t protect that privacy, then I’m urging the Legislature to act rapidly and adjust it so it does.”
Robertson was arrested by MBTA Transit Police on Aug. 12, 2010, one day after riders reported seeing him taking pictures using a phone positioned near unknown women’s crotches. One rider even snapped Robertson’s photo and forwarded it to Transit Police, who sent out plainclothes female detectives to the area where those earlier offenses occurred.
Transit Police detectives boarded a Green Line train with Robertson and soon observed him to direct his camera-enabled cell phone toward one detective’s crotch from a distance of about two to three feet. Detectives also saw that a red light on the camera was illuminated, denoting a video recording in progress. They placed him under arrest for attempting to secretly photograph a person in a partial state of nudity under Ch. 272, Sect. 105(b) of the Massachusetts General Laws.
Robertson filed a motion to dismiss the case. A Boston Municipal Court judge denied that motion, and Robertson appealed to a single justice of the SJC, who reported the issue to the full bench. Prosecutors argued that the victim was partially nude for purposes of the statute because portions of her body intentionally covered by clothing were revealed by the surreptitiously-placed camera and visible through its lens.
The high court disagreed.
“[W]e interpret the phrase, ‘a person who is … partially nude’ in the same way that the defendant does, namely, to mean a person who is partially clothed but who has one or more of the private parts of body exposed in plain view at the time that the putative defendant secretly photographs her,” Justice Margot Botsford wrote in the eight-page decision. “A female passenger on a MBTA trolley who is wearing a skirt, dress, or the like covering these parts of her body is not a person who is ‘partially nude,’ no matter what is or is not underneath the skirt by way of underwear or other clothing.”
Assistant District Attorney Cailin Campbell argued against dismissing the case. Robertson was represented by attorney Michelle Menken.

Cell Phones for Soldiers

MBTA commuters can now contribute to the community’s environmental sustainability and at the same time provide the U.S. military service men and women the ability to connect with loved ones by simply dropping their old cell phones into collection boxes at the MBTA.  On February 21, 2014, the MBTA installed two drop boxes at North Station’s Commuter Rail concourse, these receptacles will collect cell phones for the non-profit organization Cell Phones for Soldiers. The charity was founded in 2004 by the Norwell, Mass., brother and sister team of Robbie and Brittany Bergquist, who were only 12 and 13 at the time. The MBTA started internally collecting cell phones for the charity in 2012, and has since racked up over 4,000 phones and provided 45,000 minutes of talk time for soldiers overseas. The drop boxes will be at North Station’s Commuter Rail concourse for two months, and then will be rotated at two-month intervals to South Station, Back Bay Station, then back to North Station. The cell phones will go to a company that refurbishes them, then sends money to provide pre-paid calling cards with phone minutes for soldiers overseas. Since 2004 the charity has collected millions of phones which otherwise would have ended up in landfills and have provided over 200 million minutes of talk time to service members overseas.

Point of Entry Policing- Quincy Center

On February 28, 2014 at approximately 2:50 pm Transit Police officers working in Area 3 were conducting Point of Entry Policing at the MBTA Quincy Center station. While there officers observed a male, later identified as Jeremy Riley, 34 of Quincy enter through the fare gates without paying his fare. Officers approached Riley for the purpose of issuing a citation. Riley attempted to outsmart the officers and furnished a false name and social security number. The officers were undeterred and ascertained Riley's true identity which revealed there was a warrant in existence for his arrest issued out of Dorchester District Court for Operating a Motor Vehicle while being impaired by Drugs and Operating a Motor Vehicle with a Revoked License. Riley was placed into custody and transported to Transit Police HQ for the arrest booking process. During this time officers discovered Riley was in possession of prescription narcotics for which he did not have a prescription. It is expected Riley will be arraigned sometime on March 3, 2014 at Quincy District Court for violation of the Commonwealth's drug laws.

Riley was also issued a citation for fare evasion.
