Attempted Kidnapping onboard an MBTA bus Cambridge

Danyelle Abrams
On July 29, 2013 at approximately 9:20pm Transit Police officers from Area 2 received a radio call to respond to Massachusetts Avenue and Pearl Street in Cambridge for an unknown disturbance onboard an MBTA bus. Upon arrival officers located several witnesses on scene who stated the following sequence of events: a minor child (5 years of age) while waiting at the bus stop for the Route 47 along with several of his family members was approached by an unknown female who attempted to engage the child into conversation. The mother of the child was uncomfortable in the manner and general demeanor of the unknown female and walked her child away from the woman. The unknown female was persistent and again approached the child in an attempt to speak with him. Other family members intervened and requested the woman leave the child alone. This angered the woman as she began to yell at the family members. Shortly thereafter the Route 47 bus arrived and the minor child and his family boarded the bus. The woman also entered the bus and continued her attention directed at the child. Family members were demanding the woman leave the child alone, however the woman physically grabbed hold of the child by his waist(child was seated ). At this time a family member intervened and an altercation ensued. The unknown female then fled the bus.

Subsequent to an investigation by Transit Police detectives the woman has been identified as Danyelle Abrams, 36 of Boston. TPD Detectives have secured an arrest warrant issued by Cambridge District Court for Attempted Kidnapping and Assault & Battery (2 counts). Abrams is currently in custody on an unrelated arrest for Malicious Destruction of Property after Transit Police were called to Dudley MBTA station on July 30th, 2013. In that incident witnesses state Abrams shattered the glass of the Bus' door while it was stopped at the corner of Massachusetts Avenue and Washington Street. Her reason for doing so is not clear.

2 Quincy men arrested for Civil Rights Violations w/Injuries

Colin Hayes
Suffolk County District Attorney's Office Press Release :
Two Charged with Hate Crime in South Station Assault

BOSTON, July 25, 2013—Two restaurant workers were held on high bail at their arraignment on hate crime charges for allegedly beating a man at South Station while using homophobic slurs, Suffolk County District Attorney Daniel F. Conley said today.

COLIN HAYES (D.O.B. 6/30/92) of Quincy and DEREK RUIZ (D.O.B. 6/3/85) of Brockton were arraigned this afternoon in the Boston Municipal Court on charges of unarmed robbery, assault and battery, and a civil rights violation with injury, all in connection with the incident early on the morning of July 20.

Assistant District Attorney Jessica Erickson recommended $15,000 cash bail for Hayes and $20,000 for Ruiz; Judge Mark Hart Summerville imposed $15,000 for both men.

Derek Ruiz
“Transit Police detectives did an outstanding job investigating this case,” Conley said. “Their extensive efforts tracking the victim’s stolen phone made the difference in identifying suspects in this cowardly, violent, shameful act.”

The incident unfolded at about 5:40 on Saturday morning, when a Worcester man was charging his iPhone at an outlet while waiting for a train at South Station. The man reported that two young men taunted him about his clothing and used homophobic slurs, to which he responded by asking them to leave him alone.

The two men walked toward the main lobby but then returned and again engaged the victim verbally before beginning to punch him. While they were beating him, the assailants stole the victim’s phone before fleeing the station on foot.

Transit Police responded to the scene and had the victim transported to Tufts Medical Center, where he was treated for facial injuries. After interviewing him in person and later by phone, Transit Police undertook efforts to identify the perpetrators by reviewing surveillance images and locating the stolen phone.

Detectives first called the victims phone and explained to the person who answered that they were investigating the theft of a phone. In a voluntary interview, that man said he buys and sells cell phones on Craigslist and that an unknown male had contacted him in hopes of selling an iPhone.  Police seized the stolen phone and were able to obtain the phone number of the person who sold it to him.  Through further research, detectives then discovered that the seller’s phone number was included as a contact number in another Craigslist ad offering to buy and sell iPhones.

Investigators then exchanged texts with the person who posted that ad, but did not identify themselves as police officers. That person offered to purchase an iPhone and some marijuana from the detectives at a Dunkin Donuts in Andrew Square. When he met the detectives, he was in possession of more than an ounce of marijuana and he was placed under arrest.

In a subsequent interview, that man identified the person who sold him the stolen phone as “Derek” and provided detectives with a phone number for “Derek.”

The phone number came back to Ruiz, prosecutors said. Police viewed images of Ruiz on Facebook and identified him as one of the subjects seen in surveillance images they had retrieved from South Station. They also spotted one of Ruiz’s Facebook friends, later identified as Hayes, in the surveillance footage.

During the course of the investigation, police learned that the defendants worked at a bar on High Street.  Yesterday, Transit Police detectives brought surveillance images depicting both assailants to staff at the bar and Blue Inc., a nearby restaurant under the same management. Both Hayes and Ruiz were identified by Blue Inc. staff as employees.

Hayes was working in the restaurant’s kitchen at the time and agreed to speak with police.  He allegedly identified himself in the surveillance images presented by police. After being read his Miranda rights, Hayes allegedly made statements that he had left his job at midnight the night before the assault and consumed alcohol as he waited for Ruiz to leave work.  Hayes further stated that the two had engaged in a physical altercation with the victim, during which he punched the victim, prosecutors said.

Ruiz was not working at the time and was apprehended by Transit Police detectives this morning.

Hayes was represented today by attorney Leonard Milligan. Ruiz was represented by attorney William Roa. Both will return to court on Aug. 22.

MBTA Transit Police Officer Richard "Dic" Donohue and his family have received several requests from the media relative to his thoughts and feelings regarding the upcoming cover of Rolling Stone magazine. Below is a statement from Officer Donohue.

MBTA Transit Officer Donohue
"The City of Boston and the surrounding communities have faced many challenges since the bombings at the marathon finish line.  The new cover of Rolling Stone has garnered much attention due to its sensationalized depiction of one of the alleged bombers.  My family and I were personally affected by these individuals’ actions.  I cannot and do not condone the cover of the magazine, which is thoughtless at best.  However, I appreciate our country’s protection of free speech afforded to us by the Constitution.  I am confident that our Boston Strong community will remain intrepid and unshaken by the cover of this magazine."

Unfortunately, thefts of smart phones/electronic devices (most notably Apple products) is a nationwide trend. This trend often referred to as "Apple Picking" is for the most part a crime of opportunity. However there are things you can do to minimize the chances of being victimized while traveling on the T. •If possible avoid using your phone while on the MBTA except in cases of emergency/reporting via SeeSay or 911 •Conceal expensive electronic equipment •Change the color of the ear buds, would be thieves look for the distinctive white ear plugs of Apple •Refrain from listening to music or wearing headphones while riding the system •Be aware of your surroundings at all times especially if you are using your electronic device •Be aware that most robberies of electronic devices occur near the train doors •Be alert for staged distractions

In the unfortunate event you are a victim DO NOT resist, things can be replaced. Try to stay calm, hand over your device and attempt to observe the physical characteristics of the perpetrator so you can describe him/her later. Contact the Transit Police as soon as possible (immediately if practicable) after the event and report the incident. Our detectives will work diligently to get your property back and apprehend the offender. Also, if you have not done so already please passcode protect your iPhone, enable Find My iPhone and lastly download a Remote Data Wipe for iPhone. For more information or tips to protect yourself call the Intelligence Unit at 617-222-1170. We have attached a short video produced and published by the New York City Police Department titled "ElectronicDevice Safety Tips".
