Gotcha !!

On October 10th, 2012 at approximately 6:30PM Transit Police Officers assigned to Area 4 received a radio call for a suspicious male peeking into windows at the MBTA's Arborway Facility. This location is fenced off to the public and has conspicuously posted "No Trespassing", 'Prohibited Area" and "Violators will be Prosecuted" signs. As officers were canvassing the building they observed a male, later identified as Dennis Banks, 41 of Boston, MA., fitting the description provided. Banks was standing in the stairwell which leads to the basement of the building. Officers approached Banks and inquired what his purpose for being there was, Banks replied he was "taking a s***" or better stated Banks claimed he was going to the bathroom on the stairs. Officers traveled down the stairs to further investigate and located a freshly cut four foot section of half inch copper resting on a back pack.  Officers then observed a section of copper missing from an elbow joint which should have been running down the side of the building. The missing section from the building and the 4 feet section recovered by officers from Banks' backpack , they were a match !!  Officers asked Banks if the back pack was his property to which he said it was. Next to the back pack officers found a pair of hand tool pliers, inside the backpack were additional tools which would be helpful in removing copper. Banks was placed under arrest for Trespassing, Larceny and Malicious Destruction of Property and transported to Transit Police HQ for processing. Banks will appear in West Roxbury District Court sometime today.
